My old company is trying to get me fired at my current job!!!

so back in march 2004, while i was desperately looking for a job, i signed up with a consulting company(ABC). I signed a two year contract with a 5g fee if i left early. It was a QA consulting company, not my field of choice, but i was desperate.

in april 2004, they place me at a company in CT(XYZ), where i do my work for the next year or so. Right around the one year mark march 2005, i become very jaded by the work, and decide to look for a new job, fully aware of the 5g fee i would have to pony up back to the consulting company. I find a developing position (w00t) and accept the offer and all that. surprisingly enough, XYZ makes me a bigger offer to stay on with them, and i choose XYZ (hey money talks).

XYZ decides to pay my 5g fee for leaving the consulting company so i was pretty excited about that. during this transition time, the director XYZ takes me aside and tells me not to tell anyone at ABC my salary or else he'd fire me on the spot...i thought this was an odd request, because it wasn't like i was about to blab my salary to everyone...ABC also calls me up and threatens me telling me that if anyone else from my consulting company leaves under similar circumstances they will "come after me". It was a bitter phone conversation, and bridges were burned.

one month later, a guy that wasn't in my group at the company at XYZ, but also a consultant from ABC leaves the ABC, for a developing position elsewhere, the next month, another guy leaves, and then another, and then another...so now its sept 2005, and a total of 10 people have left the company for better offers elsewhere, or a career change or whatever 3 from XYZ, and 7 elsewhere...

fast forward to this past friday, the director pulls me aside, and informs me that the VP at the ABC has contacted him and told him that i've been gloating about my salary to all the people at ABC, and convincing them to leave the consulting company for better money. This is an absolute lie, and completely baseless...and according to what my director said back in march, he can fire me because of this.

this is the problem, i don't care so much that they're lying about what i did, but it will affect my reputation with XYZ, and can potentially get me fired if they keep spreading this vicious lie...

so my question to atot would be...what to do?

call up consulting company and b!tch at them for spreading lies?
leave it alone?
other...?

edited with faux company names to protect the innocent, or whatever.

Why don't you have your director call all the people that have supposedly told the consulting company that you've been gloating about your salary?
If they say no, the director will know the consulting company is lying.

No, if you call them, chances are it will be recorded and they will attempt to use it against you legally. Do not talk to any of them or any former or current employees of that company.

I'd bitch at the consulting company and drill it into them that if they don't stop with the false information they're spreading, they might see some legal action coming their way

see thats the thing about the former/current employees thing...the consulting company was pissed off at me for telling my co-workers i was leaving the company...i mean wtf? i worked with these guys for a year, and i wasn't supposed to tell them i wasn't going to be there anymore? that was pretty much the source of the falling out between me and my old company...

so after establishing friendships with these people, and i even refer two friends to the consulting company before i left, i'm not supposed to talk to them anymore?

Lay it out on the table with the person at the current company that hired you.

1) Remind them of the conditions that they imposed at hiring regarding the salary.
2) Explain what the consulting company informed you at the time of your departure.

Above are the facts.

Now present your suspicions
3) Retaliation due to people leaving the consulting company
4) That you do not feel that you have stated anything about the salary.
5) Request confirmation on names and where/when "bragging" was done.

Remember that all you had to do was to state that you were jumping for a better offer from the client to someone. That is then able to be twisted/interpreted as bragging, especially by the time it passes through 2-3 ears & mouths.

Well, my attitude is to tell them to go fvck themselves and continue on with your life as you please. However, that may not be your best course of action legally. Remember, it's not about right/wrong in the courts... it's about who has the better lawyer(s).

There are many reason why I started my own company two years ago and never looked back.

yeh thats what the director told me, he stated "don't get into a pissing contest with these guys" its not worth it, but my reputation is important...

but i get what you're saying about the legally what my best course of action is, it just sucks that my former company is being so goddamn vindictive

You do realize that it is illegal to be fired for discussing your salary, right? If they fire you for that, take them to court, and you WILL win.

1) Get a lawyer. See if you have a harrassment case.

What???

Most Company Policies state that discussing your salary with anyone is automatic termination.

What???

Most Company Policies state that discussing your salary with anyone is automatic termination.

I know it is a termination offense where I work.

I say talk to your current boss and ask him why he should beleive your former boss to whom he may have spoken to for an hour over the past year over your word? I think thats a bunch of BS but as it was stated if your fired over this you can sue.
