My G35 is hurt :(

had a car accident Wednesday morning.
wasnt that bad tho
only had my car for 6 weeks!!!!!! :(

I was behind a Ford F250 as we were getting ready to go through the Sunpass lane entrance ramp. He was going slow and there was TWO other lanes next to us I decided to move over into those lanes and just go but as i was passing him he hit my back rear left wheel with his front right bumper. When Florida Highway Patrol came, the officer told me it was my fault cause i was trying to go around him and i that i actually hit him!! He also said that if he had hit me there would be much more damage to my car?!?!?!
I was already in the lane passing him and it was my fault?? how is that possible?? so he gave me a ticket for careless driving!!

Should I take this to court??

EDIT1: no i was not trying to get in front of him
was just getting in the other lane and staying in that lane
he moved into my lane

Update1: my car will be fix by Saturday, cant wait im tired of driving a Gallant.
i finally had a chance to drive by the same toll plaza again and notice that there isnt any solid lines after the tolls BUT i thought the sunpass lane goes straight onto the turnpike without having to merge with any other lanes but actually it does have to merge to the right lane and next to that lane is the lane i was in after passing him. so he had to cross to lane to hit me??

i also talked to a lawyer and not one of those ticket lawyers and he said my insurance company will try to sort this out with their liability department and the other guys insurance and that its not worth it to take 2 court since i wasnt injured

So you were passing on the right, or doing a freeway-merge from the left? Either way, it sounds like you're in the right and the F250 jumped the gun on changing lanes. Did you spin out? That's a classic PIT manuever right there that he pulled. :D

so you're saying he intentionally rammed you with the nose of his truck? if so, i'd fight it .. and get your insurance company to fight with you since they'll have to pick up the repair tab.

If the cop wrote on the report/ticket that is was your fault, then you will have a tough time proving that HE hit YOU, and not the other way around.

I would have to agree with the trooper, how can he be the one who hit you when you were the one passing him? It would mean that you cut too close back in front of him no?

In response to wether you should take this to court, the description of the accident is a little hazy. Were you getting in the other lane to avoid him, and he tried to merge in front of you? From the accident pics, It looks like 1 - either you crept up too close and skimmed his bumper when you passed, or 2 - you were clearly in the other lane and he tried to merge 'into' you. If #2, any body shop where you have the repairs done will be able to solidify your court case, I would imagine. Good luck.

almost lost control of the rear but i wasnt going tat fast, prob about 30mph

Hey man its ok-some moron hit my '02 MB SLK 230 a couple of weeks ago. Just for a dent on the fender, I paid to get a new fender whoch cost $675. Cheer up man!!! Max this will cost is a $1000. Don't worry, I know you feel like sh!t, I did as well, but realize it always could be worse.

nope they already quoted me $2600 and they a havent checked if there was mechanical damage yet

I'd fight that... if you were just passing cause he was going slow, you should fight it.
when you are merging anyways, you should not be going slow, it's dangerous for christ sakes... IMO not your fault, but that's just my opinion.

you are not supposed to pass anyone while merging onto a highway from an onramp.

common sense. sucks your car got damaged but it's your fault for being impatient.

yes my 2002 530i got rear ended a couple weeks ago. don't see me crying about it here.
