My friend got into a car accident.. who's at fault?

Ok, you guys judge who's mostly at fault in this parking lot accident. My friend was pulling out of his parking spot at a little strip mall. There's traffic running both ways. On one side of the traffic, there's a car waiting for our parking spot. On the other side of the traffic, there's another car, apparently want us to get out before he get into the empty spot to our right. On our left is a minivan making it difficult for my friend to look for oncoming cars. Well, since there are two cars blocking the way my friend thought he would be safe to pull out of his spot. As he pull out about halfway a car from his blind side hit his car's left bumper. Now everyone's pissed because two perfectly good parking spots can't be used. How likely is it that the person hitting my friend's car will get 100% at fault? Since she's on the wrong side of the traffic. Secondly, she was definitely going faster than the posted limit in the parking lot of 15mph.

so you are saying a woman was making a pass in a parking lot? Her fault, i think.

Since two cars were stopped, waiting for someone to back out of a parking spot, the person who hit your friend must have passed the stopped cars. It's reasonable to assume someone will be pulling out of a parking spot when you see this scenario, so if you are impatient enough to pass a stopped car (passing into oncoming traffic ), you must do so slowly, with extreme caution. Obviously the other person is at fault, 100%.

your friends screwed the rite of way was the girls. it happened to my wife in a park and fly. the other driver ended up suing us and our insurance paid it.

the right of way always goes to the person who isn't pulling out of a spot, regardless of the fact that its impossible to see beyond the two jacked up chevys you're parked between and that there were two people waiting. which is stupid.

the question is: is it illegal to pass in a parking lot?

The only accident I've ever been involved in was very similar. I was in a parking garage, about 5 spaces from the end of a row where you had to make a u-turn to go up to the next level. I (used to) park there every single day, and I know to watch for people coming down from the next level.

I turn my head about three times while backing out to keep watching both behind me, and for people coming down from the next level. One day I'm slowly backing out and some jerk comes flying down the ramp. He was already around the corner while I was looking behind me, and when I turned back to look at the ramp again he tried to go around me while I was already 80% out of the space.

My fault - I was backing up, and he wasn't.
