My eBay/PayPal "scammed" story...

Backstory:

I sell refurbished iPhones through my website and through eBay (yeah, eBay sucks but it's all about the exposure.)

Back in September I sold 4 refurbished iPhone 4 models white in color to a guy in Florida for $1600. He gets them in, inquires about purchasing more of them, and all seems hunky-dorey. The next day out of the blue, he messages me to tell me that all the iPhones I sent him were fake:

"NONE of the serial numbers matches with the phones sent. I took the phones to APPLE SERVICE CENTER and they told me that all these phones are FAKE. The reasons they gave me is as under:

1. The top and bottom plates are not original as the original plates are screwed whereas the plates on these phones are GLUED.

2. The parts fitted inside are ALL FAKE and NOT OF APPLE.

3. On my request to replace them and am ready to pay the replacement charges for which they refused because they do not replace fake phones anD suggested me to return the phones TO THE SELLER.

Since I do not trust you hence the question of returning theM without getting the money back FIRST, the question of my returning the phones does not arise. If you want your phones back then refund the money immediately otherwise I will not only report the matter to Ebay and Paypal but to the local police as to sell fake items ON LINE is a criminal offense. This fraud is known as MAIL FRAUD.

It is better for you to refund the money immediately and send a prepaid return label to get the phones back. Rest is your wish. I will wait for another half hour to see your action and if I do not receive then I will proceed further."

He then proceeded to open up a case on eBay... and sent me back a package (Here's the tracking # 1ZY5F4020399392741)

Of course when the package arrived, it was a phone book. A phone book from Jacksonville FL. Since he sent the package via UPS and not USPS I can't get him in trouble. (Youtube video time, as I recorded myself opening it)

So after providing all the information to eBay regarding this guy they side in favor with me.

Fast forward to october... this jerk decides to file a chargeback, to which PayPal obviously doesn't do shit. They tell me they can only fax information for the chargeback so clearly the bank that filed the chargeback didn't see the evidence of him sending me a phonebook.

So he has the 4 iPhones I sent him and the money... now I'm out over $2800. PayPal won't do anything, eBay won't do anything. The police won't do anything. I can't get the back information from PayPal without a subpoena and lawyers around the area here are clueless as to how they'd be able to help me.

I guess that's going to be a fun loss to use as a tax write-off

If I lived down in Florida I'd at least swing by his shop by I don't... Jacksonville Fl police (or sheriff's) won't do anything either. The one sheriff I talked to said if it was him he'd be kicking the guy's ass but obviously it'd be too hard for me since I live so far away (mind you our conversation was being recorded... haha)

Damn that sucks. I really don't know what you could do besides drive down and have a pleasant talk with him.

Paypal is also a shitty company. They want to act like a bank but have none of the legal responsibilities of a bank and also just fuck everyone over in the process. Only can fax information about a chargeback? Yeah right. They can't mail stuff?

Well I've thought about small claims court but the problem is even if I win because he doesn't show up (which I'm sure he wouldn't) I'd then have to hire some company to try to collect the money... no guarantee that I'd ever see a penny but I could be out money by filing and hiring a company to garnish his wages...

Sorry to hear that dude. The question you need to ask yourself is if you're willing to devote more time and money to pursue this guy? He's gambling that you won't.

but I can have free iPhone? Since you're practically giving it away

Well at the time my margins weren't very good... now days they are great... I'm just thinking that he thinks I won't do anything about it.

I've called him a few times and he acts like it never happened... very confused about the entire situation. Maybe he runs that many scams?

Why would you send him the money back if you knew the phones you sent him were not fake. And if he files a charge back, eBay and PayPal need to discuss with you what happen as well before they give him any money.

WOW dude Sorry for the loss, I have has similar things happen on ebay, but never in the larger amount of money. Scary..

yea not really following the story. i re-read that part like 5 times and still didn't understand it, unless he is saying that the "chargeback" they did means they took the money directly from his bank account to give the other guy.

but that doesn't make sense since he said they were on his side.

I just assumed he added the value of the iPhones + the chargeback = >$2800 as what he meant

Send a paypal money request to his paypal address. This will open a transaction . List your original tracking number as proof of shipment. Then submit a claim via paypal that the invoice hasn't been paid and reference your original transaction in which paypal sided with you.

This will at least get someone from paypal looking at it again.

Because paypal is a middleman, if someone does a chargeback, paypal will take the money out from your account whether they side with you or not. They are not going to eat the loss for you. This is what I've been lead to believe is the MO of paypal and is why everyone hates them. As long as the money is under their control, they will back you but once a chargeback is filed, they lookout for themselves first before anyone.

edit: This is also a major reason why people don't keep a positive balance on their paypal accounts. Once a chargeback is filed, your balance goes negative and paypal will stop acting all friendly and come after you for their money. Such is business although I don't think and don't hold me to it that they are able to hit your credit score if you ignore paypal afterwards.

I still don't get it. eBay owns PayPal, so why would PayPal do this if you won the eBay case?

Why can't you just do the same thing he did, in reverse?
