My Ebay Auction was Removed

I bought a laptop recently on ebay, and listed it for sale as a new, unopened laptop. It was a 7 day auction, and today there was a little over 2 days left, and ebay removed the auction. Here is the e-mail i received.

----
**PLEASE READ THIS IMPORTANT EMAIL REGARDING YOUR LISTING(S)**

We would like to let you know that we removed your listing:

673502xxxx Brand New Dell Inspiron 1150 2.6 GHz Laptop 512MB 40GB

because the intellectual property rights owner notified us, under penalty of perjury, that your listing or the item itself infringes their copyright, trademark, or other rights.

We have credited any associated fees to your account. We have also notified the bidders that the listing(s) was removed, and that they are not obligated to complete the transaction.

If you relist this or any other similar items on eBay, your account likely will be suspended.

I dont think there is anything wrong with selling a new laptop on ebay...The only thing that i may have done wrong was to use a picture from the dell website of the laptop, but i was hosting the pic on my own web server so i didnt think that was such a big deal.

Wow, that's a pretty harsh email... I dont think linking to their pictures would draw that type of response... :Q

That's why you got the email. Also, you CANNOT use their description of the laptop, you must use your own. If you relist without making and changes, your account might be suspended, so watch out.

eBay sucks like that. I was trying to sell 2 SWA flight vouchers for a friend and they cancelled one, sent a threatening email saying there is a limit of one per month (what kind of crap is that, one per month). One more infraction and I would have my spotless 300+ account cancelled!

What pissed me off is there were at leasy 5 other sellers with back-to-back auctions for SWA, selling WAY more than one per month! And I'm the one that gets hassled. I complained to eBay, but still didn't see any of the other auctions get pulled.

For profit companies sit on EBAy to hunt for this kind of thing. Truely pathetic as it won't increase a companies sales. The itme will sell and the demand will not change.

I've used item deescriptions from manufacturers before. how is that illegal?

I think that pretty much answers your question. Are we allowed to use information from a website for specifications? For example, I'm selling an IPOD and I just rip all the information from Apple's website.

Another trick is to copy Dell's description of the item, but put that text in a jpg. They scan the auctions for text, as long as the filename is different than the file on dell's server, the odds of them catching it is very small.

I sold my laptop on ebay and used my own pictures and own description and no problems.

on the other hand a friend was selling a different product and i took a picture for him of it and then some other ebay user used our picture on his auction and we reported him to ebay and he got a similar message like you for copyright issues.
