my dad's company isn't paying him... read inside please *updated with situation*

ok who cares, i'm gonna post it anyway.

so his company hasn't been paying employees for a month and his boss claimed that he needs to wait till the client pays him in order for him to pay the employees. is this legal?

No but if they have no money to give what does he expect? I'd suggest he find another job immediately and then go about recovering his unpaid wages, but if they're in that bad of a shape I'd want to bail

Of course they have money, your dad's boss is still there and prob getting paid? plus the company has assests it can liquidate if needed.

It depends on the size of the company, the boss may be the owner and has no money but is there for his business interests or he may just be another employee like the guys father hoping they make it. As far as liquidation of assets, thats probably going to take a while, and the question of if they have enough assets to repay all of their creditors comes into play. Its a bad situation no matter what and the important thing is really to get out and find a new job and worry about getting the back pay afterwards.

And, does your dad earn a salary, or is his pay based on some sort of comission? Comission wages, as I understand it, do not have to be paid until the client has paid the company.

It sounds like a crapshoot for your dad. If he believes the company will recover and has savings to live on, he rides it out. Could payoff later. If the company is going down, he needs to get out. Sueing a broke company probably will not get him anywhere.

One of the many very tough decisions a person has to make in his lifetime.

Hope it works out for you folks.

edit: When a company can't make payroll, it's usually the end.

All your dad has to do is contact the Calif. State Labor Relations Board. They will get his money. He doesn't need to contact a lawyer.
