So i owe the IRS about 6000 from back taxes, this was back in 2006, in august 2007 after they already took my 2200 return they put a levy on my check, which i made agreement and they started taking 55 dollars a week to pay this debt, they also took my return for the 2007 year about 1700 + 600 they send everybody. So far they took about 5000 from returns only, i know they have fees and Interest they charge so i figured my debt should be today about 8000, minus 5000 they taking in my returns= 3000. thats how i calculated in my head. when i got my last check of 2008 i saw that the levy for that year alone was 2834 dollars which in theory should be enough to clear my debt. so i called the IRS since they have not stopped taking money from my paycheck and turns out i still owe them 2892 dollars, so i asked but you have taking more than that from my paycheck, i still owe u more? they said well we have not yet got any payments from your company which is the reason u still owe 2892 dollars, after i argued a bit over the phone i called my manager and let him know of the problem which he said he will take care of it. this call was made the day after MLK day. and to this day the IRS have not got any money from my company and no one knows where the money is.

My question is, what do the bright minds of ATOT think my next step should be? the IRS just says: you have to talk to your company, company says well the levy was put for 6k you still got about 1800 to go, so we cant stop taking the money, I say well if you dont give the IRS their money im never going to finish paying them. and thats where im stuck now.

Your company should fix this and cover any interest that has accrued due to their mis-steps. If not, see them in court.

Find every pay stub you can, & tax records, & your w-4 Contact HR/payroll & get copies to fill in the gaps.
You have to show evidence that your paycheck has been deducted regularly so that it has be their computer problem.

When the IRS orders a levy against a delinquent taxpayer with that taxpayers employer doesn't that order carry a similar force of law as a court order? I always thought that IRS orders always had the force of law behind them unless specifically overturned by a court order. If that is the case and I can't say that it is but if it is I would say your company is in violation of the law and can be subject potential criminal penalties for in effect ignoring the lawful order of levy from the IRS. I'd try B.S.ing them with that anyway and see what happens.
