I have 330ci with the Performance Package (ZHP) and got hit in the back by a lady with a Aston Martin DB9 (think it's an aston martin). Anyways, my rear bumber is ripped and needs to be replaced. Insurance Company of the lady (Farmers) called me and claims they can replace my bumber with an aftermarket part as long as it is visually identical. Is this true? I assumed they would have to replace it with a genuine BMW part.

All I can say is BITCH, BITCH, BITCH. Bitch and moan till they are SICK of hearing you. At which point you will take it to the BMW specified body shop and they will pay for it. Has always worked for me.
take it to a body shop that works with bmw parts or is associated with a bmw dealer.

There are so many ways to be a pain in the insurance company's ass. Call them up. Visually identical, huh? Well, let me see them both side by side. Hmm, this one is a different color, this one doesn't look as thick, blah blah blah. This thin POS ain't goin on my car. Seriously, question everything they say. Make it HARD as fvck for them. You will get what you want.

You picked a really nice car to get hit by. You've been elevated several notches in my book.
Sadly, insurance companies let body shops use aftermarket products and worse yet used parts. Sometimes they'll have to perform body repair on the used part that they're installing on your car. I've had them do this and it is legit for the insurance company. That was in Washington State, but I assume it is the same in California. BTW, I collided with a lowly deer and have not yet reached your high status.

In NC the law states the car must be repaired to like condition before. And yes they are allowed to use aftermarket parts as long as they look/fit like the original.
I hate insurance companies, but this rule/law keeps car companies from charging too much since they would have a almost monopoly on their parts.
What you can do is make sure you get a estimate from a good repair shop. Don;t go solely by theirs if that is what your repair is being based off of. Also make sure if they do use aftermarket parts to get a warranty.

I do. Though, I grew up with the attitude if someone is bothering you, then just ignore it. Much easier to do when you're online too.
