A young Gig Harbor woman who contends her Tacoma Community College music instructor coerced her into taking off her clothes and touching herself during singing lessons has sued the state and the teacher.

The woman, identified as S.N. in the lawsuit, filed suit in Pierce County Superior Court last week.

She contends the community college failed in its duty to protect her from instructor Kevin Gausepohl, who she claims took advantage of her for his sexual gratification.

The suit, filed on her behalf by attorney Lance Hester, seeks unspecified damages, but she previously filed a $1.25 million claim against the state.

Spokesman Shawn Jennison said the college is cooperating with state officials in defending the suit but offered no specifics, citing the school’s policy on pending litigation. “The safety and well-being of all TCC students and staff is a top priority,” Jennison said.

Efforts to reach Gausepohl, who resigned his position in October 2011, were unsuccessful.

He told investigators two years ago he “vehemently” denies all of the allegations against him, college records show.

The woman was a 17-year-old high school student attending the community college as part of the Running Start program two years ago when she made her allegations against Gausepohl, according to court and college records.

He allegedly told the girl he was conducting a study on how sexual arousal affects vocal range, and she complied with some of his requests to strip or touch herself during voice lessons at the school, court records show.

Gausepohl, 38, masturbated during one session while she played piano, the woman contends.

The music instructor allegedly made similar requests of other students, who declined to participate, court records show.

“These students became concerned that defendant Gausepohl was sexually exploiting plaintiff, and they reported it to TCC authorities in the spring of 2011,” her lawsuit states.

College officials did nothing until she finally came forward, she contends.

The alleged abuse caused the woman “great alarm, surprise and emotional distress,” among other damages, the lawsuit states.

Community college officials hired an outside agency to investigate the matter in fall 2011. That agency concluded that Gausepohl, “more likely than not,” violated the college policies on sexual harassment and discrimination. He eventually was charged in Tacoma Municipal Court with seven misdemeanor counts of communicating with a minor for immoral purposes and one count of obstructing law enforcement.

Gausepohl reached a deal where prosecutors agreed not to pursue the charges if he stayed out of trouble for a year. He kept his side of the bargain, and prosecutors dismissed the case earlier this month, court records show.

Yes, sue the state for 1.25mil because it's the state's fault. Gawdamit. She should only be entitled to that perv's money not the public. One person's "emotional distress" (an overly used unquantifiable phrase) is not grounds to screw over education for the general populous. Knock it off with the greed.

BTW, she lives in my state so I have every right to be pissed.
 
I don't feel sorry for a girl who lets this go more than one time. At 17, you know the situation you are in is wrong. If she wasn't at the police station or in someone's office immediately after the first time it happens, I have no sympathy for her, and I would not award her a penny.

Mount Washington, Kentucky, incident

On April 9, 2004, a call was made to a McDonald's restaurant in Mount Washington, Kentucky. According to assistant manager Donna Summers, the caller identified himself as a policeman, "Officer Scott", and gave a vague description of a slightly-built young white woman with dark hair suspected of theft. Summers believed this described Louise Ogborn, a female employee on duty. After the caller demanded that the employee be searched at the store because no officers were available at the moment to handle such a minor matter, the employee was brought into an office and ordered to remove her clothes, which Summers placed in a plastic bag and took to her car at the caller's instruction. Another assistant manager, Kim Dockery,[1] was present during this time, believing she was there as a witness to the search. After an hour Dockery left and Summers told the caller that she was also required at the counter. The caller then told her to bring in someone she trusted to assist.[2]
Summers called her fiancé, Walter Nix, who arrived and took over from Summers. Told that a policeman was on the phone, Nix followed the caller's directions for the next two hours. He removed the apron the employee had covered herself with and ordered her to dance and perform jumping jacks. Nix then ordered the employee to insert her fingers into her vagina and expose her genital cavity to him as part of the search. He also ordered her to sit on his lap and kiss him, and when she refused he spanked her until she promised to comply. The caller also spoke to the employee, demanding that she do as she was told or face worse punishment. Recalling this period of time, the employee said that "I was scared for my life."
After the employee had been in the office for two and a half hours, she was ordered to perform oral sex on Nix.
Summers returned to the office periodically, and during these visits the employee was instructed by the caller to cover herself up with the apron. Becoming uneasy with the situation, Nix was then permitted by the caller to leave, on the condition that Summers had to find someone to replace him. After Nix left, he called a friend and told him "I have done something terribly bad."[2]
With Nix leaving and short on available staff due to the dinnertime rush, Summers spotted Thomas Simms, the store maintenance man who had stopped at the restaurant for dessert, in the lobby and instructed him to enter the office to watch the employee. Simms refused to go along with the caller's demands. At this point, Summers became suspicious and decided to call the store manager, whom the caller had claimed to have on another phone line. Speaking with her boss, Summers then discovered that the store manager had been napping and had not spoken to any police officers, and that the call had been a hoax. The caller quickly hung up. An employee dialed *69 before another call could ring in, to get the telephone number of the caller's phone. Summers, now hysterical, began apologizing and released the employee (by then shivering and wrapped in an emergency blanket) after 3½ hours of false arrest and then called the police, who arrested Nix for sexual assault and began an investigation to find the caller.
The entire incident was captured on a surveillance camera in the office. Summers watched the tape later that night, and according to her attorney, called off the engagement.[2]
