MSI is giving me the runaround on a RMA

Not sure if this belongs in OT, but I thought somebody here would have better input...

I bought an MSI 6600GT AGP here on AT from another trader (a good trader who I've traded with before). Card arrived fine but had definite "issues".

So I sent it in for RMA. MSI sent me a refurb 6600GT (different serial). This card looked to be working OK for a couple hours and then gave me that nVidia power warning (weird cuz I have a good 500W PSU). It then corrupted text in Oblivion and textures in CSS. Seemed to be heat related since it would happen after 10-15 minutes.

I RMAed the card. MSI sent it back doing nothing. I sent the card again in for a 3rd RMA after giving a detailed complaint over the phone. They checked it again and sent it back w/o doing anything.

What are my rights now as a consumer? I'm not the original purchaser, but they had no problem doing 3 RMAs (with me paying for shipping first 2 times). I asked to get the next higher AGP card and the guy at MSI said it's not likely (prior to 3rd RMA) since it would be a 7300GS.

Should I file a complaint with BBB?

It's like pulling teeth with this company. EVGA - just sent them a bare dead card and then sent a NIB card.

Technically you wern't entitled to any RMA from MSI at all because you arn't the original buyer of the card, so theres not much in the way of recourse for you in this situation... did you find out why they sent the card back to you without doing anything?

Dude :(... They don't send your card back without testing your card on 3D 2003 and 3D 2006 mark. if it doesn't crash in the testing processes then the card is alright. So i think the issue is with your Power Supply.

I could have the original buyer RMA it and I'd still get the runaround. They never asked for proof of purchase. I'm not sure what they warranty policy is since it's not really an issue in this case. I know EVGA doesn't care if you're not the original buyer.

The PSU is not the issue. I've tested the card on 2 boards and 3 different PSUs. Still getting the same graphical corruption. If it was just one game I wouldn't care, but it's failing under 3 games.

I ran it through 3DMark 05 and it seems to do fine there but in game it definitely has issues.

Any other suggestions?
