Moral Dilemma

Reader's Digest Version:

- Last August, we took in my wife's best friend and her two kids when she abruptly left her husband. They had just moved to Chicago (from Houston) for his new job. She came back with the kids and moved in with us.

- Until December, we did not charge her any rent, utilities or groceries.

- December, we charged her $100 every two weeks.

- December 18th, she is involved in a serious accident while using our truck. Two others are involved. She insists it is not her fault and tells me she has a witness to support her. However, she gets a ticket [for no insurance (I have it, it just wasn't in the car) and having our truck in a lane while she was stopped to the side of the road), as well as one of the other drivers. She pays $100 for our rental (covers the cost). Following week, she sends her kids to Chicago to be with their dad. The hassle of all this pisses me off, but I realize it's not the end of the world.

- January - Truck gets fixed, but we have to fork over $1000 for our deductible. Truck is not the same, of course. My wife tells her she expects her to pick up the cost. She agrees.

- Her court date for her ticket rolls around. She previously tells us that she will being going to court to fight the ticket. Instead, she packs up her stuff and moves back to Chicago. Idiot does NOT give Post Office a forwarding address. We start receiving all kinds of mail for her and her husband. It's currently in a manilla envelope.

- Find out from the insurance company that what she told them and what she told me are quit different. In fact, she ADMITS that she believes SHE WAS AT FAULT for the accident! Insurance agency informs me that my policy will be found at fault (no final verdict has been rendered yet). I am beyond pissed!

- Couple weeks later, court sends her a notice that she missed her court date and requests her to call to reschedule. We received the notice at our house.

- Wife texts her about her about the $1000 deductible. The bitch tells her "Fine, I will pay $100 a month starting this month, I didn't think I would have to pay it all." WTF?

- As of today - We haven't received a dime (and I don't expect to). We DID, however, recieve in the mail a notice from the court telling her a warrant has been issued for her arrest. hahahahaha......

okay, now my dilemma: My nice guy persona is having a battle with my bad dude persona. I'm not exactly sure where she lives, and I don't believe I have any legal obligation to get it to her, but should I try to contact her and let her know of the warrant? Should I call the court to let them know she doesn't live here any longer? Should I not do anything and keep my fingers crossed that she gets arrested?

I would tell the court where she lives and to stop sending crap to me, but not tell her about the warrant. But thats just the dick head in me.

I would contact the court just to save yourself the hassle of having to have a deputy "come in and look around" if they ever get bored and actually try to serve the warrant.

Other than that, I wouldn't do much. Sorry that your good intents and generosity netted you a leach and put you out a few grand.

So is your insurance co going to charge you the full cost of repair to your truck?

Figure out whatever you have to do to stop getting her mail and whatever you can do to give back all the mail of hers that you have received, let them know that she doesn't live there anymore and was only staying under temporary living conditions, tell your wife she has 1 less friend.

File in small claims, get her summoned. Let the judge know about the warrant if she shows, and take a default judgement if she doesnt.

no, just had to pay the deductible. But, here in Texas, even if I wasn't driving, it is my insurance that is on the hook for the other drivers if she is found at fault.

You seem to have two separate issues. First, you seem to be looking for gratitude for allowing her in your home which is a fruitless endeavor. I don't think that's why you did it.

Second, she had an accident in your car and should definitely pay for your damages. Sounds like she has a problem with responsibility. Unfortunately, the reality of your situation is that it is unlikely you will get any money from her. Try not to let this discourage you from doing a good turn for the next person in need.

Bottom line is the situation sucks! Have a beer!

1) Try to get her committment to pay the deductible in WRITING. that way, you have evidence to back up a small claims if needed.

2) Send the CERTIFIED manila envelope to her - let it be her headache. Also, inform her that she needs to notify the PO - you will not forward any other mail.

3) Notify the courts that the person does not live with you - this as others stated is pre-emptive

Let the court know she no longer lives with you and to stop sending the mail.
Any mail that shows up, do a return to sender.

It should eventually catch up to her....one can hope.

Don't know all the details, but it would appear to me she took... advantage of you kind folks and then ran away like she did before...

Good question. She initially told us it was just for a week. Then it was for good, but she didn't tell us when she was going to leave. At that point, however, it didn't really matter to us. We believed she would pay for the deductible. And we believed she was telling us the truth about the accident. That's the only two things that mattered to me.

btw, sorry to hear about this strange series of events CPA. It was nice of you though open your house to a troubled family. don't change that.

No, his deductible is what it is. However his insurance policy will be paying for everyone else's car repairs too and his rates will probably skyrocket.

What a pain.

so far, they haven't. Allstate has "Accident Forgiveness", so i'm keeping my fingers crossed they won't. My agent has stated they won't, but I'm not 100% convinced yet.
