OEMs and companies like DELL, HP, ACER etc who are members of the PCI/SIG group won't use product without PCIE certification.

Nobody will stop Nvidia/Asus from making product that is NON-Compliant but Members of PCI/SIG group(PC Makers, OEMS, Chip makers) won't endorse the product.

btw, it is stupid to make this argument. we all know what the pci-e spec is. It was created a long time ago when nobody expected power draw to get this high. the cards will work just fine, and I'm pretty confident that asus doesn't give a shit if dell buys any of them or not.
