It's damned tough to overcome the presumption that the rear-ender is at fault - there is an almost overwhelming presumption that the rear party's negligence caused the accident. If you had some third party who would support your side of the story you might have a chance. You might want to fight it because it would likely lead to a reduced fine, at a minimum.

Entirely your fault dude, regardless of what speed you were going.

If you can't react in time, or your car's brakes aren't good enough, you shouldn't have a license or be driving that car.

Wow - a 19 YO driving an SLK? What a country! That won't help in court, because, fairly or not, a judge is not going to give a 19 YO the benefit of the doubt when it comes to driving safety.

wow, 4 points at 19... you really need to work on your driving skillz, kid :) as a rule of thumb, for every additional 10 mph you are going, increase your following distance by that amount of cars. for example, 10 mph= 1 car following distance, 20 =2, 50=5 and so on.

You hit the other car because you were following too closely and could not react in time. Just be happy that the other car wasn't braking really hard because a little kid ran in front of it.

i had the same thing happen, they said i was at fault no matter what. if you go to court you get a lesser fine, the cop even said that.

Uh oh. That sucks. :Q :(

I dont know about Florida but in California you can take traffic school again even if its still within 18 months... only difference is its 12 hours instead of 8 and can't be online.

Online traffic school takes like 20 minutes.... just FYI, I know it's suppsoed to be an 8 hour class.

A rather good definition of following to close is when you run into the person you where following. Maybe you could claim you where drunk and not pay attion but your where a proper following distance.
