Modem COMM/IRQ conflict

AMD700, A161 motherboard.
Everythin installs good expect the modem.
PNP installs it to COMM5 and either IRQ5 or IRQ10.
There are devices using every IRQ.
But the device does not say it has a coflict.
But when i try to acces the modem it says "cannot access port"?
