So I might get laid off or fired soon, depending on the whims of management.

When I get dragged into the HR director's office, what should I do if they want me to sign something? Is there anything that I shouldn't sign? Does anyone have any experience with this?
 
Always have the agreement reviewed by an attorney first. When I offer severance to people, I always tell them to have it reviewed by an attorney.

also OP, why laid off or fired, you fuck up or is the company just cutting back?

40 is the age set by the ADEA, which the OWBPA falls under.

ADEA & OWBPA? two acronyms I've never seen.

I did everything I could on one project, and honestly I don't know what more I could have done. It was dependent on the government getting its crap together. Needless to say, the government didn't, management ignored my suggestions, and now we're facing a fine. This might get me fired, since they might decide they need a scapegoat.

Also, company sales are down 50% compared to last year. They've already laid off half the workers on the manufacturing floor. I think management might frame my termination as a layoff to avoid any legal problems. The company has a history of "eliminating job positions" and then shuffling others around to fill the void until they find someone new who can do the same old job.

tefleming, thanks for the info. I hit 40 recently, so I guess there's something positive there.
 
First off...you're not required to sign ANYTHING when you're laid off or fired.

You don't HAVE to participate in the "exit review" unless you want to.

Just tell them to get your fucking check.


Next, being over 40 doesn't stop them from firing you for cause, NOR from laying you off in a reduction of force scenario.

IF you can prove that you're let go because of your age, you have some protections, but it's very hard to prove.
(unless they get rid of everyone over 40 all at once, while keeping only "the kids.")
