No, the courts found them to be a monopoly (nothing wrong with that).

Furthermore, the appeals court reaffirmed the judgment that they illegally abused that monopoly to stifle competition. It was the Bush administration's DoJ that sold out the verdict by negotiating a completely tooth-less settlement. Basically their argument was, "the economy is struggling and we're pro-business so let them off the hook". As it turns out, Judge CKK went along with the final settlement terms.

Being a monopoly is NOT illegal but using your monopoly power to stifle competition is and m$ was found guilty of that.
