I think this clearly demonstrates that the US patent system sucks. There are clear examples of this already on the internet, and you can't say that it was patented before they existed, since the patent was only filed for in Dec. '07 and just granted on the 11th of June.

while i agree the system is stupid, i have stopped hating the companies that file for these(within reason. i still hate the companies that file for them just to sue later on). microsoft and apple have to file for these seemingly simple/ridiculous patents to protect themselves from the mega lawsuits later on when some small fly by night company sues them for infringing. they are doing what they have to in the current system.

To get patent protection your invention must be:

* new, not known anywhere in the world prior to filing
* have an inventive step, not obvious or a simple adaptation or combination of existing products

To many software patents are granted when there is evidence of prior work, or they are simply a combination/adoption of other ideas.

There's prior art-hotornot.com, atleast i'd consider it prior art. But I'd have to look at their claims. They may be patenting something new.

Scratch that. hotornot probably won't qualify as prior art because in the MS patent, it's comparing a pair of images/multimedia files
