I'm set for final orders (11-22-02) on my 13 year old daughter's custody-I've had custody for the last 4+ years, ex wife lost it & tried to leave the emmigrate to the UK with our child & I ended up with custody, (one of the 1% of men in TX granted custody of their children under the age of 10).

Was expecting a slam dunk (threw her in jail for 3 days & 2 nights 2 years ago for non-payment of child support, and she hasn't dared to come back to the US since.

Last night after she talked to our daughter on the phone, the kid says that Mom's planning on coming back for the hearing. FVCK...

I spent the morning @ the courthouse getting another record of non-payment (no child support for 7 months & counting, & she refuses to pay medical bills), stopping by the attny's office (had to show her how Windows XP supports CD burning, she was having a problem with Roxio's latest upgrade) and wrote her a big check for enforcement of contempt, 8 counts...

Lawyer says with this, she'll probably never dare to come to the US again:|

She's an unfit parent, evidenced by her 2 visits with our daughter over the last 4+ years.

Not sure if she'll really come, or if it's a ploy to make me crazy (crazier?).

& yes I'll post pics if she shows up:)

Update:

Ex didn't show up, her attny had to settle for grilling me for 45 minutes.

Outcome was one of the options I'd put on the table, and all my other requests were honored.

1.) Visitation overseas allowed with a $20K bond, deposited to my attny's trust fund.
2.) Airfare paid entirely by ex, ticket must be round trip, delivered to me.
3.) child support bumped up to a whopping $246/month (from $157, I had to do the math for the attny's & judge to convert pounds to dollars & calculate what she needed to pay, & the judge agreed with my figures)
4.) Any visitation in the states, and Ex must give me her passport for the duration of the visit
5.) Ex (or her agents cannot contact me @ work, call my employer, or ask to speak to child @ school)
6.) Medical expenses to be split.
7.) Ex can call child on phone up to 3X per week, (we don't have to be @ home, but must have cell phone available-ex didn't want to call our cell phone & demanded we be physically @ home before, a serious PITA, 2X a week)
8.) Continued her obligation of child support (currently unpaid, that's another case) from the temporary orders.
9.) Assessed her court costs $300, and $1K of my attny fees.

I wasn't supportive of any visitation, but had offered to allow if the cash bond was paid.

I have to respect the judge, she left a door open for my ex, but she'll have to jump through some hoops to exercise visitation, there are some good safeguards in place, and we probably won't have any more hearings about custody/visitation ever again (unless we have a bench warrant for her, I'll have to ask the courts to vacate the current visitation schedule, till the bench warrant is cleared.

Phase 2

We filed contempt charges against her (the ex); she blew through the $1K limit I set on unpaid child support this month, & are looking @ actually sending a process server to England (I can get a $350 fare round trip through Orbitz.com) and have her served for contempt. If she fails to show, there'll be a bench warrant issued, and she'll automatically go to jail if she presents to the US & I call the police.

Anyone want to become an officer of the court & stalk her in England for me?

Whew, now how to figure out how to explain to my daughter all the "If your mom does this, and if you mom agrees to that..."


Since she didn't show up, no pics, sorry. Mentioned to my wife that I could just take a photo of her attny, you-all would be happy, but she threatened to kick my a$$ if I took one of him...

As the child of divorced parents, there is some good news. I also live in Texas, and at age 12 the judge felt I was old enough to decide where I wanted to live. There is a really good chance that if your daughter says she wants to stay with you the judge will let her. This is especially true when you consider all that your ex has done (or hasn't done as the case may be).

Edit: I'm 30 now. Hopefully the Texas judicial system hasn't gone down the crapper in the last 18 years.

Good Luck going about your Case the right way, legally and all :)

I haven't had good luck with Laws, and trying to do everything legally, seems there are so many loopholes in law enforcement around this area. But that's AR for you

I ask her every once in a while about living with me, her answer is: "I already made my choice.":D

The judge had taken her into chambers @ age 8, & asked when the initial custody hearing happened. It was unusual, but the whole case was unusual.

She knows I'd do anything for her & that I've gone above & beyond what most non-custodial dads did to keep her in my life, try a 160 mile/day commute for one, and a 40 mile round trip to pick her up & or drop her off @ school or her mom's house for a couple of years, 2X a week. Or the time when I negotiated with the local Police Dept to have her brought to my by the Police Chief when he didn't have to, or the year & a half we made the visitation exchange @ the Police Dept because my ex made so many bogus 911 calls, that they had had it with her & forced her to come to the PD or they'd throw her in jail.

I'll never forget the night I turned it around, ex had left for the 3rd or fourth time, we'd been divorced for about a year, I dared to ask for the kid to have a winter coat (it was December) when she was shoved out on the doorstep in a t shirt, then drug back in & the door slammed in my face & I could hear her screaming @ the 911 operator that I was harassing her....

I sat on the doorstep for a few minutes waiting for the police,wondering if I should just leave & look guilty, and suddenly had a thought, "I'll just go to the PD, it'll remove me from the BS @ ex's house, I'll be where the police know where I am, & I won't look guilty. Did that 4-5 times & the police were suddenly on my side (they are guys, & they could see I was just trying to be the best dad I could be).

Now, AFA whether or not she'll show up...it all depends on how psychotic she really is. She must know that she has warrants and if she shows up....*CLICK*...go the cuffs. :D

You're approaching the light at the end of the tunnel. There is light and you'll find it. :)

*evil laughing* Then, when you have full legal custody, you can set "whatever visitation times suit your schedule." *more evil laughing*

I know, I know; you're more adult than that...but you WANT to, don't you? ;)

Damn, our situations are SO similar. I go thru the same crap (including the police) allthough they're not as nice to me. :( Afterall, she IS the "custodial parent" and therefore couldn't possibly be wrong, now could she?

Nope, she's from NE Texas, little rural town, met a looser (currently unemployed) on the internet (got a lot of milage from that 4 years ago too).

My endgame (I gave this one to the lawyer & he closed with it)-the Court cannot be a party to an illegal act, she was leaving to settle in the UK on a tourist Visa, (& was stupid enough for us to lay the groundwork about her Visa) big no-no

MichaelD, your time will come.

When you're dealing with the police, remember that they don't want to be there or involved, it's crap like this that gets them hurt & killed.

Practice your Zen-like skills to be calm. cool, collected & right, (I always felt anything but that).

The clerk @ the Child Support office was nice, she was supposed to charge me for the paperwork, but when she saw I was recieving child support & that I hadn't gotten any for 7 months, she didn't even charge me for it:D

Thanks for the support, all, I'm stressed this week, feel like I'm going to battle. On the advice of the head shrinkers, I'm asking for the "No overseas visitation" to be extended indefinitely.

Just 5 years till the kid's 18..., seems like yesterday...

Congratulations my friend!!! That IS excellent news. I gotta hand it to you; you sure made it damn-near impossible for her to see the kid...20K bond, hand you the passport...did you try to get one of those electronic ankle monitors mandatory too? :D Hahahahah!!! Good for you...chalk one up for the good guy. :)

You're much smarter than I on all that warrant/process/bond/back support stuff....explain about vacating the visitation until the support is paid.

Does that mean that basically, she can't see the kid until her "account is current?" Bahahah ! She'll never pay up...I guess she's out of your hair for a loooooong time, no?

Again, I am very happy for you...I know the path you've walked quite well.

Bond/warrant/etc-in TX, as in most states, child support & visitation are 2 seperate issues, however, if there's a warrant out for her arrest for failure to appear if she's served a suponea for non payment of child support, I suspect we throw the visitation overseas out the window till the bench warrant is honored; if she presents to the US for visitation, she'll be arrested.

The bond/child support/cort costs/lawyer fees will be a little tough to honor since she makes $17,800/year. Oh wait, if her employer keeps out the $247/month & pays it directly to me, she'll only make $14,836.

Ain't life a bitch?

Hell, why NOT garnish her paycheck? She's refused to pay on her own...obviously demonstrating her inability to care for her child and monitor her own financial affairs!

Heck, I was paying my son's mom cash and checks on my OWN every month until our court date for CS/visitation came up. They IMMEDIATELY garnished my paychecks for my child support (which in retrospect is a great thing..one less check I gotta write/mail every mo.) even though I had already demonstrated my willingness to pay.

hmm..i'm reading through all this stuff and i don't really understand...
when u have children and then divorce isn't the guy supposed to pay child
support?...it seems like ur asking for child support from her?

i mean from what i seen, its like the guy always gotto do the payin..for
the child and even the divorced wife.

Whoever has custody gets the child support, so if the man gets custody, the woman pays..
