I think .08 is BS.

Maybe other people can't drive with .08 but I honestly can drive FINE.

I think it varies from person to person as well.

.12 is far from blasted probably had two glasses of wine.

The limits are way too low. There was a bar in San Luis Obispo calls Bulls that had a breathlyzer in there and I could be almost sober ~1-2 beers and blow .08.. after about 7 I'd blow 2.0ish.... and still drive surf etc whatever fine...With scotch the effects were even worse one shot put you over the limit.
every year we have a demonstration at my school. We have one person get wasted, a few hours beforehand, and then they get the normal dui check. These peopel have been very drunk and only blown a 1.5

Funny how it works out that you think your the only one who can drive a .08. I bet everyother drunk out on the roads thinks the same.

You can read the antisemetic statements that the officer reported that Mel Gibson made on the second page of the documents posted at that link.

Edit: Another site seems to have gotten confirmation the documents posted are apparently authentic and accurately describe the arrest.
Another Website was able to get a "confirmation" on the record.

"Lt. Steve Smith, in charge of the detective bureau for the Malibu/Lost Hills station of the Los Angeles County Sheriff's Department, confirmed to me just now that "the contents seem to be similar" between the official reports and the four pages posted by TMZ.com on the Internet alleging Mel Gibson "blurted out a barrage of anti-Semitic remarks" -- "****** Jews" and "The Jews are responsible for all the wars in the world" and asking the arresting deputy "Are you a Jew?" -- during his DUI arrest early Friday morning," reports Nikki Finke for Deadline Hollywood Daily.

Lt. Smith denied that there was any "cover-up."

"There's no whitewash," Smith told Deadline Hollywood Daily. "I've seen the first report, and the supplemental report, and it looks to be the same thing as what's on the Internet."

They are still pretty damn drunk , clearly not sober enough to drive.

Leave it to the Christians to get drunk and kill innocent people on the road. So this breaks down into 2 different things....

all sarcasm aside, I think anybody who drives while drinking is a real piece of sh!t. People think, "I only drank a little bit"... or "I've done it before, so it can't EVER be a problem"... So the next time you plan on drinking and driving just load a single bullet into a gun and point it at your head and pull the trigger... You might hit an empty chamber!! That means the next time you put the gun to your head and pull the trigger it can't EVER happen!!! Yay for logical thinking!!!

The breathalyzer you're describing is far from forensically accurate, since hard liquor can't get you any more drunk than beer or wine, assuming the same number of drinks. What you're describing is the effect of alcohol still in your mouth at the time you blew - this is a non-factor in police tests, since by the time a suspect is taking a Breathalyzer at the station (the portable field breathalyzers are not forensically valid tests), several minutes have elapsed since they drank.

Everyone is different, but on average a .12 BAC for someone Mel Gibson's size (180 pounds) equates to 7 drinks over a 2-hour period. I personally think staunch DUI activists are sometimes guilty of exaggerating the risks of DUI, but there's no question someone with a .12 BAC is dangerously impaired.

Don - that machine had a state stamp on it and was high end. So I don't dispute it's accuracy but the lingering alcohol in mouth effects I agree with you did affect the testing. I did'nt know the cops take you someplace else to test...It was a most useful tool even so, as you would'nt get behind the wheel if you were over... But like all good things can be abused...I think they took it out when some idiot died having a competition who could blow the highest. :frown:

Fine. And when will we all realize that the Passion of the Christ was anti-semitic and not Mel's attempt at historical accuracy?
The most dangerous people aren't the ones spouting hatred. Its the ones who are shrewd enough to inject their bias subtly. Mel did a great job of just going over the line a little in "Passion" and then stood back and let the Christian right defend him and claiming anti-Christian bias.
The truth is now known publicly what many people have said about Mel. He's a good guy with a far out Christian view of the world. He is far from the mainstream and his beliefs have been denounced by responsible Christian leaders, including Pope John Paul II.
Now lets not crucify(sic) Mel. He is a result of his fathers rabid anti-semitism. Hopefully his kids will think for themselves and come to different beliefs.

I'm with you all the way man. This is an obvious case of profiling. The cops were probably pulling over every fancy lexus that was going 85+ mph in that 45 zone.

Gibson was arrested after deputies stopped his 2006 Lexus LS 430 for speeding at 2:36 a.m. Friday. Sheriff's spokesman Steve Whitmore said deputies clocked him doing 87 mph in a 45 mph zone.

I've seen news where someone pulled over a couple minutes after leaving the house, who had just used a alcohol based mouthwash, blew over the limit.
I think they took it out when some idiot died having a competition who could blow the highest.

Just was reading an article about the anti-semitic rant - I don't have time to research right now, but does anybody know the source of the released rant? I don't doubt it could be true, but with how carefully the police department was handling this, I'm a bit surprised it was released, and it got me to wondering if this is really an invention rather than fact.

The site has a link to a PDF of the arresting officer's original, hand written report. It's difficult to read, but the quoted remarks are on the second page, just below the black tear or shadow on the left side.

No. Erratic driving and/or the smell of booze on a driver, or the presence of alcolhol in the vehichle would constitute probable cause to test a driver suspected of DUI.
