STAFFORD, Va. (Feb. 21) - The 25-year-old military wife convicted of throwing a cup of ice into a car that cut her off on Interstate 95 in Virginia has been sentenced to probation.

Jessica Hall of Jacksonville, N.C., has been in jail for more than a month since her bond was revoked by a Stafford County judge.

A jury had recommended that Hall serve two years in prison, but the judge noted today that Hall has no criminal record and placed her on probation for the felony conviction.

Hall's husband is in Iraq serving in the military. She admits flinging the cup of ice over her car into the other vehicle in anger after it cut her off twice in traffic. She says she was shocked by her conviction and concerned about her three young children.

After learning of her probated sentence, Hall thanked the judge and began to cry.

i am two minds on this. yes throwing a cup of ice into a car could be dangerous. but nobody was hurt so jailtime may be overkill.


but i really do not care either way heh.

After the jury makes such a stupidass sentence, the should then be banned from ever serving on another jury again.

Hope she isnt planning on voting. Too bad too, be interesting to see how military families vote this election.

5 years of probation is overkill... you get a 1 year probation for a ticket for reckless driving... i don't see how this is worse.

edit: i noticed in the op, there's no mention of a 5 year probation... might wanna edit it to reflect that.

The jury has to follow sentencing guidelines, two years was the minimum they could recommend. I'm perfectly OK with the judge dropping it though, as much as she was out of line it doesn't warrant jail time IMO.

Probation is probably better, it keeps her out of jail as long as she behaves herself. If it turns out she can't manage that then she can do her two years for all I care.

she was not held in jail for a month just on this.

"Hall thanked Judge Frank A. Hoss Jr. and wept after he put her on probation for five years. She has been in jail since Jan. 4. Though she was ordered free on the Virginia charges, she remained held there on a Mississippi warrant on suspicion of writing bad checks. "
