State Rep. Habay sentenced, resigns from Legislature
Wednesday, February 08, 2006
By Steve Levin, Pittsburgh Post-Gazette
State Rep. Jeff Habay was sentenced today to 6 to 12 months for his conviction of making his staff do campaign work on state time.
The Shaler Republican also resigned from the Legislature, effective today.
Mr. Habay's wife and mother spoke on his behalf at today's sentencing in Allegheny County court.
Mr. Habay said "I beg your honor for probation."
But Judge Jeffrey Manning noted Mr. Habay's "egregious" lack of remorse after his conviction.
He ordered him to spend 6 to 12 months of incarceration, followed by four years of probation. But Judge Manning also allowed Mr. Habay to seek alternative housing, such as a halfway house for nonviolent offenders, and allowed him to seek a work-release program.
Mr. Habay, 39, must report by March 6.
A second trial for Mr. Habay, on charges that he intimidated witnesses and made a false anthrax report to police, is scheduled for this month.
