GREENSBURG, Pa. (Nov. 3) - A man claims his ex-girlfriend owes him more than $30,000 for gluing his genitals to his abdomen five years ago. "This was not just some petty domestic squabble," attorney Grey Pratt told a Westmoreland County jury Wednesday.

His client, Kenneth Slaby of Pittsburgh, is suing Gail O'Toole of Murrysville. His lawsuit claims the two broke up in 1999 after dating for 10 months and Slaby began dating someone else.

Slaby contends that O'Toole invited him over to her home on May 7, 2000, where he fell asleep. He woke up to find that O'Toole had used Super Glue to stick his genitals to his abdomen, glued his buttocks together and spelled out a profanity on his back in nail polish.

Slaby said O'Toole told him it was payback for their breakup, and he had to walk a mile to a gas station to call for help. He pressed charges and O'Toole pleaded guilty to misdemeanor assault and served six months' probation.

O'Toole's attorney, Chuck Evans, said it was a consensual act and Slaby wasn't permanently damaged.

"This is a case that should have been left in the bedroom," he said.

Gail O'Toole, of Murrysville, comes out of a Westmoreland County Courthouse Friday afternoon after a jury found for the plantiff, her former boyfriend, Kenneth Slaby, of Pittsburgh. O'Toole was charged suite with gluing Slaby's groin area and painting on his cheeks with red nail polish.
Gail O'Toole said the glue and the nail polish were part of a consensual sex act, one that has her stuck paying $46,200 in damages.

A jury of 10 men and two women in Westmoreland County court decided that O'Toole's ex-boyfriend, Kenneth Slaby, should be awarded the money after O'Toole invited him into her home and then glued his groin area while he was napping.

"I didn't do this for any cause. I didn't do this to hurt anybody. I did this to please the man I was in love with. It's not the first time," said O'Toole, 56, of Murrysville. "I just thought that people do these things because there's some girl somewhere who knows he likes this."

Slaby, 58, of Pittsburgh, said the ordeal was painful and embarrassing.

"Today was a proven fact that I'm a victim and she's paying the price," Slaby said.

According to court papers, the two dated for about 10 months in 1999. After O'Toole broke up with him, Slaby began dating someone else. When that relationship ended, Slaby and O'Toole began seeing each other again.

On May 7, 2000, O'Toole glued Slaby's penis to his stomach, his testicles to his leg and his rectum shut. Court papers say he woke up in her bedroom with nail polish in his hair and profanity written on his skin.

Leading up to the incident was an alleged marriage proposal with a secondhand ring, according to O'Toole. Slaby denied he proposed. O'Toole testified she underwent "a series of disappointments" during her time with Slaby.

O'Toole served six months of probation after pleading guilty to misdemeanor assault in June 2000.

Her lawyer, Chuck Evans, of Pittsburgh, said his client took the plea to avoid jail time. The guilty plea gave Slaby leverage in the civil proceeding and prevented O'Toole from being able to elaborate on circumstances of the incident in her testimony, Evans said.

O'Toole testified that she collects about $800 a month in alimony and disability payments she receives for bipolar disorder.

After the verdict, O'Toole said she didn't know how she'd pay the money. She said she would be talking to Evans about possibly appealing.

Slaby admitted to the jury that he had no permanent injuries. The contractor said he didn't lose any income either.

After walking nearly a mile to a convenience store to phone 911, Slaby spent four hours at Forbes Regional Hospital, Monroeville, until nurses had to peel his flesh apart. An oil used to dissolve the glue didn't work.

The jury deliberated for about two and a half hours before delivering the verdict.

Jury foreman Shaun Cilli said he was surprised there were so many men on the jury. He thought there would be a more even split between men and women.

In spite of that, Cilli said, the award for Slaby was not a slam dunk.

"It was definitely split," Cilli said. "That's what took us a good bit of time. ... But when it was all said and done, everybody was happy with the verdict."
