man you always hear about dude doing something like spitting on a cop and getting charged with assault. but i guess busting in a chicks coffee is different. i pays to know the law ahead of time!

He was charged with sexual assault and the judge said per the law what occurred did not qualify as a sexual assault. I'm surprised that he was not charged with tampering as well.

John Robert Lind was charged with sexual assault but a judge said the Minnesota man's conduct didn't qualify as such because of a loophole in Minnesota law that doesn't consider his behavior a sex crime.

I would have imagined a lot of women would be too embarrassed to even talk about this. Good for the woman for going public with this. The guy is stupid though, if he liked her he should have just asked her out to lunch. What a moron.

The prosecutor is lazy though, you can usually get someone on other charges even if not sex crimes. Like battery or food tampering. Also, she may win a civil lawsuit against him for intentional infliction of emotional distress if nothing else.

Assault requires that you feel threatened.

You can be assaulted by someone raising their clenched fist at you like they are going to punch you.

Battery requires an actual unwanted touching, which this was.

At least in tort law.

This was definitely battery under tort law, and I'm not sure how it wasn't far, far more under criminal law. Guess I'll read the actual story.
