So Cop Breaks His Arm Apart

SALT LAKE CITY (CN) – Heber City police broke an elderly man’s prosthetic arm during a bogus arrest for driving in Utah with a Colorado license, the man claims in Federal Court.
Danny Baker sued police Officers Michael Stowe and Officer Brunnell on Jan. 30, seeking $1.5 million in damages, plus treble damages.
Baker has a prosthetic arm due to a construction accident in the 1970s.
He says he spends a lot of time in Utah for medical reasons, and that he drives slowly there because he likes to keep an eye out for deer and elk.

Cops do not have to read your rights to arrest you. Where do people get this stupid shit?

They can detain people for a short time for any reason AFAIK. At least until you can be seen by a judge.

People just don't know how to cop. Need to get some PSA's out there or something about how to behave around police. I think the lack of respect goes both ways.

They can detain you.....but then for a judge to see you, they have to arrest you or charge you with something.....

The key words there are "the man claims in federal court". Anyone can claim anything, I have no idea what actually happened.

Television. I saw somebody on an forum recently very confident that if a person had not been read their miranda that they hadn't been arrested. Absolutely untrue; it's perfectly legal to arrest somebody without reading them their miranda.

People get a lot of their knowledge of the law from movies and tv shows, or from their asses.

This makes me wonder because a lot of people have bad shoulders and are not flexible enough to put their arms behind their back properly. However, we don't know if maybe the person resisted arrest and it forced the police to be a little rougher on them. I tend not to move to quick judgments in cases like these.

Maybe he regularly buys drugs in Colorado.

Having an encounter with the police is turning into a win/win proposition. They either kill you which is fine because living in a world with police that corrupt is not worth it or you get to sue and be rich.

Let's get the LEO side of the license story before jumping to judgement on what started the issue.

Roughing up a person if they are not resisting is different issue and wrong there.
