I think he should be charged with something. If one of my kids were shown in that video being sung sexually explicit lyrics to, and my child being portrayed as enjoying it, I'd go all the way up the chain to make sure at the very least he's labeled a sexual predator for the rest of his life.

Not to mention he admits that it was pre-meditated.

When the local news is video taping a high school football game, do they have consent from the school to put the video of the kids in the stands on TV during their high school football breakdown show? I'm wondering if he will even get in trouble for using the kid's images because (I'm just speculating here) but didn't he get consent from the school when the teacher (a representative of the school) allow him to video tape the kids? Obviously he totally misrepresented what he was going to use their images for, so maybe he can get in trouble for that? Just some random thoughts of mine...

That's a good question - the permission releases to play the sport may actually include such verbage.

Keep in mind, none of this was an issue when I was in school. All I know is now my kids come home every few weeks with some sort of release.

Getting consent from the school isn't good enough anymore. It's gotta be from the parent.

And yea, that's stupid. People do this kind of crap all the time and nobody gives a damn.

Right, but what about when the news camera pans the crowd and zooms in on the student section? There's a bunch of underage kids with their images being shown on the breakdown show. Totally different scenario from the OP of course, but it seems that the consent issue is also kind of a grey area.

I guess he could be charged with "being a creep". But being a sexual predator? Who did he prey on, and who were the victims of this "crime"? Was ANYONE harmed in ANY WAY by any of this?

Or do you want to "charge him with something" because you're afraid he might one day actually prey on your kid?

Basically he planned on making quick to judge people look like idiots. He succeeded but they still want to arrest him. I think he'll win except for some BS "disturbing the peace" charge or something like that. He was stupid, but he found a loophole.

If he earns money from the vid, he should be forced to either pay the kids or blur them out.

At worst he could get hit with something like defamation. This was not broadcast, bt it is starting to cross the line from "personal video" to "Public Broadcast" when posted to some place like YT and they really need to start defining the rules a bit better on internet vids.

As for Sexual exploitation? Predator? BS.

This is just a bunch of hyper overprotective parents and paranoid school administrators jumping on a burning bandwagon.

something like by buying a ticket or entering the stadium during a game you consent to be filmed. Its a bit different than being in a class room.

Just google the SNL skit with Peyton Manning.... exact same thing except it wasn't sexually explicit. But it did show (through editing) Peyton Manning f-bombing some kids among other things. Pretty funny skit considering it was Peyton.

I suppose people have gotten busted of upload pics of nude adults that had the heads of underage girls photoshopped onto them... but this doesn't seem like the same thing. If the lyrics suggested harming the children sexually while it was overlaid on their faces... I can see why people could be upset but haven't heard the lyrics.

EDIT: after seeing the lyrics... I can safely say the guy was an idiot. Still not worth a 20 year felony... but a stupid thing to do.
