Clyde man charged after holding young vandals in closet while waiting for police

Man catches juvenile delinquents vandalizing a home with hammers, surprises them while they're inside smashing up the place, forces them into the nearby closet and shuts them in while he calls police. No harm done to the youths except for being 'frightened'. Man is charged with endangering the welfare of a child. Youths probably referred to counseling at tax payer expense (e.g. victim assistance) because they were "victims" of a crime.

Yeah, that was not good judgement on his part. If he was able to force them into a closet he was able to march them out to the front steps and sit them down there, or whatever. I'm not saying he should be charged. As far as I'm concerned he caught them damaging his property and should be able to restrain them however he wishes until the cops arrive, as long as he does them no physical harm. But sticking them in a closet is just asking for some do-gooders to take the side of the kids. Vandalism cases are almost always locals, and once you lay eyes on them everyone knows who they are, and the cops can go get them at home. Personally, I would grab some shots with my phone, but I wouldn't lay hands on them.

I don't blame him at all for detaining them. As he said in the video, he wasn't exactly sure where they live and what their names where, and even if he did they could have went home and cleaned up and it would have been his world versus theirs. He would then be out the damages of the property as well.

From the video it sounds like they did try and get away a few times and keeping them detained in enclosed area was needed. I don't see how he was endangering them in anyway. Because he had a hammer in his hand that he took away from them and they perceived it as a threat?

Bullshit. In such a tiny town, what 3k people, it should be perfectly normal for kids that age to be out playing by themselves. This fucking nanny state got people thinking every kid has to be watched 24/7. Fucking ridiculous.

Yup, and when the father found out what these kids were doing they would have normally received a really good ass whipping for it. No asswhippings and helicopter parenting for another generation of non-self reliant losers.

Two 8 year olds... My kid is 7, I can't imagine them being out at 9PM especially without me, let alone in someone's house with hammers..

Only in america. My mom would slap the shit out of me afterwards and profusely apologize to the neighbor.

The dad guy talking bullshit about kids being "traumatized" ... they fucking should be. They were destroying someone else's property, WTF does he expect the owners reaction will be?

I bet the dad is hoping to get out of having to pay 20k (half of the 40k since 2 of the 4 kids were his) if he can blame the other guy.

Under New York State law, a juvenile can only be held liable for up to $1500 in damages. Richard Muoio could be awarded only a maximum of $6000 in restitution for all the damage done.

He could still try and sue in civil court and get the money from the parents. parents should have to pay if the kids can't.
