Apples to oranges. A gay person still had the right to marry. The gay couple didn't. Yes, he has the right to marry, but the second couple (him and second wife) don't.
Subtle but distinct difference especially if you are talking about equal protection, which would appear to pertain to individual citizens, not couples.
He has the right to marry a second wife, too. No one is denying him that. He just has to legally divorce the first one beforehand.
