Maine City Bans Smoking in Cars With Kids

BANGOR AP (Jan. 9) - The Bangor City Council approved a measure Monday that prohibits people from smoking in vehicles when children are present.

When the law goes into effect next week, Bangor will become the first municipality in Maine to have such a law. Similar statewide measures have been adopted in Arkansas and Louisiana and are under consideration in several other states.

People who smoke with children present in the confined space of a car or truck might as well be deliberately trying to kill those children, said City Councilor Patricia Blanchette, who is a smoker.

"Let's step up to the plate and lead; our children are worth the fight," she said.

The ordinance, which was approved by a 6-3 vote, applies to any motor vehicles on any public roads within the city. Violators face fines of up to $50.

An amendment that was added Monday to the original proposal makes the violation a primary offense, rather than a secondary offense. That means police can pull over vehicles if they see somebody smoking with anybody under 18 in the vehicle; if it were a secondary offense, police would have to stop the vehicle for some other reason, such as speeding.

Several residents, doctors and representatives from the Bangor Region Chamber of Commerce and the Fusion Bangor development group spoke in favor of the ordinance.

Pediatrician Robert Holmberg said the evidence is "incontrovertible" that exposure to cigarette smoke causes medical disorders in children, including asthma, bronchitis, ear infections and heart disease.

"Children are the most in need of the protection by public policy, because they can't protect themselves," he said.

But the ordinance also had its critics.

Councilor Susan Hawes, who voted against the law, said the police department should devote its energy to more important issues. There's already too much government intervention in people's lives, she said.

Aaron Prill of Bangor told the council that the ordinance was a "feel-good option" that was not intended to protect children but rather to "moralize" against smokers. Most smokers have enough common sense not to smoke around children, he said.

I quit smoking and plan on never touching a cigarette ever again, but I dont like when the government bans things.

Whats next?
I dunno, but erosion of rights is bad, no matter how insignificant or stupid the right seems.

Don't like it either... my town is trying to get smoke free bars... I hate the idea and I hate smoke in the bars. Personally I think it is the right of the owner to decide that... I you dont wanna be in a smokey bar go to a bar that doesnt have smoking.
 
Im 16, im not bothered by second hand smoke. So would this mean if my aunt smokes in the car when im in there, she gets pulled over even if i dont care?

This is f*cking ridiculous. I hate living in this state. I live in the bigger city of Portland, Maine and soon this will be adopted here. Guaranteed. This state sucks. We are poorer than Mississippi and older than Florida and our taxes are the highest in the nation second only to California. Yeah, they are really trying to kill their children. Brilliant. 😕 I don't even smoke and this enrages me. Smoking is in no way healthy but if they can't smoke in their car, soon it will be illegal to speak of religion to your children. And why the car? I lived with a chain smoker for 4 years and it was far worse in the house. This makes sense on zero levels.

Yea most of it does, if u open the window a crack the smoke will go out of that window, just make sure its one window! its cos the pressure differences.

Whats the legal age to smoke in US?

I think there is no legal age to actually smoke, they say that purchase(and possession?) is for 18+. Amounts to the same thing. Someone correct me if I'm wrong.
 
This is f*cking ridiculous. I hate living in this state. I live in the bigger city of Portland, Maine and soon this will be adopted here. Guaranteed. This state sucks. Lived in Augusta for many years and I can tell you that even though the economy has sufferred for quite some time, Maine is a very good place to stay and raise children. I was a smoker for many years and now that I have quit it really pisses me off to see a parent holding their child in one arm and a cigarette in another...the ban is not on cigarette smoking in cars..it is on cig smoking in cars with children... Honestly, if I still smoked and I had children.. I sure as hell wouldnt be mixing them together anyways..

 
I grew up in Portland, currently away at school right now. I can't agree with this law though. I am not a smoker, and hate smoking/second hand smoke BUT your car is a "private area." I am all in favor of how we banned in in restaurants, bars yada yada, because those are "public areas." They can regulate things like that, as its public, but to start doing it to peoples personal spaces? What next banning it in my home? I don't think so. I foresee this going up the appeals courts and will get overturned.
