So I made a deal with a guy on Craig's List and just got this phone from him (Treo 755p). I don't think this guy is intentionally being shady but then again, I don't know him very well.

The batteries were dead when he gave me the phone so I didn't play with it there, I can see why he stopped using it because he had a demo phone from Sprint they gave him (The new HTC touch) I knew what phone I wanted and wasn't worried about it. He stated the phone is about a month old and only used for 2 weeks. There aren't any major marks on it so it seemed legit.

Well I get home and plug it into the charger and play with it a bit. Seems to work normal until I hit the side button (below the volume buttons) and it is stuck. Button doesn't work. Luckily I don't mind that I can't use the button but I'd prefer it worked stating the phone was new.

The guy WORKS at the Sprint store and stated he won it from some contest. He was working when I bought it from him so I know he works there.

He seems pretty legit in trying to get it fixed but he kinda was doin the "I just used that button 3 days ago" type thing which also seems legit because he posted this deals 2 days ago.

I guess what I want to figure out is:

Can he get in trouble for selling me this phone being an employee?
Can I figure out the history based on the ESN of the phone?
Any tips you guys have?

I don't want to receive a refurbished phone if they can't fix this button. I also don't like the idea of them having to take it apart either, being that he claimed it was new.

Thoughts?

EDIT EDIT:

I just found a screen on the phone that tells me how many minutes have been used and it is over 6000. Having only "used the phone for 2 weeks" I highly doubt this is legit.

It also says warranty date 6/18/2007 so I'm under the assumption it was activated in June originally.

He knows of the issue. He hasn't replied to my last 2 text messages though which is a bit concerning. He is definitely one of those "Salesman". I just wondering about the legitimacy of the age/history of this phone now.

Find out where he works and call the store manager? There's probably nothing they can do, but you never know. That's the problem with Craig's List is that it's so wide open and there's no protection.

You shouldn't text him as that leaves him room to ignore the issue. I would call next. If he ignores you further, go into his work. May be a little inappropriate but if he gives a shit about his job, he'll take care of you.

I bought it from him while he was working...he was in full uniform and everything and in front of multiple employees.

He called as soon as I mentioned the issue and tried to work through it over the phone but now he knows it is a physical problem. I really don't want to have to drive back out to the store he is at but I guess its probably worth it :-/

Edit: And I still want to know the history of the phone.
