The title says it all. I am looking for a modern game that is as close as possible to the original Privateer. Here are my requirements:

1) Not Freelancer - beat it but game was too ridgid
2) Made in year 2001 or higher
3) Open ended where you can go off and do your own thing and completly blow off the main story line (if there is one)
4) Can go the route of cargo hauler, fighter, miner, etc.
5) Can buy new ships and new weapons/armor/devices.
6) Can be MMO or not.
7) Good flight/battle system.
8) Fun

there's an MMORPG called EVE that sounds like it would fit everything you have in mind.
flight and battle system is very weak/crappy. its all automatic, you hve not control other than what guns to use and when to turn on your shield.

i found the game to be extremely boring though.

there's also the X series, latest one is X3: The Threat. never played it but it sounds like it has what you want also.

It doesn't fit all your criteria but nonetheless have you ever played Independence War 2? It's graphics are still good but it's combat engine is alot of fun! You can stalk ships at gates or space stations and pirate their cargo. Sometimes they drop blueprints which you can use to manufacture things in your secret base.

You say, "not Freelancer", but Freelancer will do all that. Start a LAN server, then Join. There's no rigidity at all, do whatever you want. Download Mods for even greater variety and freedom. Or play Online.

Did not know about mods and such for that game. When I played it, I only did the single player mode which basically prevented one from upgrading their ship/weapons till you got to the next sector after completing a number of quests or requirements.

So in the multiplayer version you can port to wherever you want, buy whatever you want and fight however you want?

Or how about the Privateer Remake? ;)

Space Rangers 2 has good gameplay that manages to overcome what is essentially a 2D space map locked at 1024x768. It's like Sid Meier's: Pirates!, except it's in space. The planetside base construction/warfare is in 3D however.

As said also, Independence War 2 is a great game with combat as good or better than Freespace 2, but with a little trading and economy thrown in. The cargo ship AI is bad though, with frequent gate pile-ups. Subsequent patches may have cleared this up.

X3 is also a good choice, but I would recommend waiting until the next patch (1.3) comes out. It should fix the performance problems and tighten up the AI, which is lacking right now. The graphics are by far the best ever seen in a space sim and the universe is extremely open-ended, albeit with quite a few flaws which one would expect with an unfinished game.

Yes, no locks on most gates(there are 3ish gates from Singleplayer that don't work in Multi without Mods), goto any system, and buy any ship(except the huge Transports and Battleships, againn some Mods allow it though). Some Mods add new ships, new Planets, new Tradeable Goods/Resources, and new Systems. You can Mine, Trade, do Missions, ambush.

I wish I could recommend you some true Privateer experiences, but the fact is if they existed, I'd be playing them right now. I bought X3 thinking I'd get some really awesome combat, but it is mainly built around trade. I'm currently trying EVE but it deffinitely is more strategy based than actual combat based.

EVE is more travel, mining, and boredom based

I would think you need to stop posting your personal experiences as factual. I think that makes you seem quite matter-of-fact and since you are wrong... it also makes you sound ignorant to what EVE is.

EVE is what you make it. It can be tactical, it can be romantic ( as in Romanticism ), it can be cruel, it can be boring, it can be exciting, it can be adventurous, it can be risky, it can be the total domination of your enemy and/or friends ( if you so choose ).

If it is a boring mining and traveling simulation then maybe you failed to realize the scope of the game. If you failed to obtain a enjoyable standard of PvP then maybe you didn't have the brass that it took to compete in the universe? My corporation helps new players obtain a level of living that doesn't require them to be drones to a certain gameplay. Seems to me you just lack imagination.
