Long read.... mean person has a package that belongs to me...wont return!!!

Ok fellows, prepare for a long read. If you read, please advise. Thanks!

First off, my chinese uncle who doesn't speak english goes to the store Marcs (pharmacy chain around Ohio) to develop some film that he wants to send back home to his relatives in China. After he sent the pictures home to China where his relatives also don't speak english, they decide to send him some herbal medicine that can only be bought from overseas. They however, lost the envelope that my uncle had sent him the pictures in. Being illiterate in english, they do not know any better than to do this - they dont have a return address since the envelope was gone; they do see one address however on the package that held the pictures... The address of the Marcs pharmacy. They assume that's where my uncle resides.

They sent the package via UPS to Marcs. My uncle after some time calls them to see what's up with the medicine. Anyway, he finds out it was shipped to the wrong place, goes to Marcs, and tries to track down the package. After lots of run arounds, and calling around, we find it's in the hands of ... lets call him Joe, who works at Marcs corporate. Joe for some reason won't give us the package back. He says it's foreign material that he can either send back or give to the police to check out. Keep in mind the package was not addressed to anyone but my uncle. Wrong address, but still my uncle's name. I tell Joe, ok, give it to the police because the contents are not illegal, but be sure to get the name/number of the police or DEA, or whatever so I can track this package!!

Days go by. I call Joe, he says he's given it to the local police, but doesn't have a name or number which I specifically asked for. ARG!!! Now after some more run around and call about, it turns out the local police knows nothing of this package. I call Joe back.... Days past... no answer.

For all I know now, Joe either threw it away or kept it, or whatever?!! The package contents are very important to my uncle and all he wants is for it to be returned. Joe is making my life and my uncle's life very difficult. I left a message with his secretary today: call us back tomorrow, or this will go to small claims court.

Any advice? I mean Joe cannot just keep this package cause it's not addressed to him!! If he's open it, isn't that a federal crime? What legal action can we take on this mofo?!!

---- edit: also, my uncle told me that the medicine/herbs in there are worth $400+

talk to your postmaster? interfering with delivery of mail is a federal crime, but you'd have to see if this constitutes that.

It was shipped UPS, Postmaster won't do anything.

On the other hand, write a nice letter demanding the package be returned within specified amount of time or you will sue him. Sent it Certified Mail so you'll know he got it. Keep detailed records of all your communications, they'll come in handy should you take him to court.

Also request a notorized letter from the police that they have no record of any package being given to them matching the description of yours, and that they have no knowledge of receiving it. It should help close off that possible alibi.

Call UPS. They probably deliver to Marcs on a regular basis and can apply enough pressure to get your package back. You could also call the police and fill out a police report for theft.

That guy sounds like a real AHOLE. I would call every corporate suit at Marc's until either his head was on a platter or I got the package.

Call every one above him in corporate. If that fails:

#1-Call the police and get a certified note that they don't know what the guy is talking about.
#2-Get a note, in writing, from the guy stating that he gave it to the police.
#3-Call UPS and explain the problem.
#4-Send the guy a copy of the police note by certified mail, and state that you will press charges and sue if he does not return it one day after recieving the letter.
#5-Contact a lawyer and report the stolen item to the police, give them both a copy of the letter the guy gave you.
#6-Contact every paper/radio station in town. Mention the name of the business over and over and over again.

Call it a hunch, but something tells me that importing organic materials from China is illegal in its own right...?

Well, if this is possible, what I would do is send the family back in China some money, have them re-send herbal shipment to correct address.

What to do with the ahole working at Marcs, well perhaps you will get some good ideas from this thread :)
