No it dosen't. He's saying with his information you can buy the system for much less than $249.99.

He's a scum for exploiting the inherent laziness of the average ebayer who dares not bother to read the description of what they're buying, true; however, this is just a crafty business oppurtunity. It's not really fraud unless there are no apparent warnings at all. In this case, there is one, albeit a small one.

The category it is listed under is certainly fraud, and the ad is clearly deceptive. Too bad some suckers buy these auctions and are then too embarassed to go after the seller.

The definition of fraud, accoring to dictionary.com, is:
'A deception deliberately practiced in order to secure unfair or unlawful gain.'

He may be deliberatly playing with people's heads but he does have a warning; therefore, it is not entirely a deception. I'm not a lawyer though so I guess I can't interpret how the law sees a so-called 'deception' so I guess you can take whatever I have to say with a grain of salt. I would however be quite interested in what a lawyer would say on the matter.

A service provider will get you on the phone, and run you through a battery of simple yes questions so fast that you end up answering yes to a question that results in charges, all without knowing it. While some quick people can catch what's going on, and answer no, most people can't keep up, and end up answering yes, so the scheme is effective most of the time. This kind of scheme is no different; both are designed with the sole intent to trick the buyer in to buying something they wouldn't normally buy, and both are acts of scumbags.

I agree with you, they are scumbrags, but how does the law interpret this? Is it illegal or not? I'm dying to know.
