Lock Ups In Games

I got this new rig so I can play new games like Oblivion. But the game keeps locking up and I have to restart my computer. So I go back to playing NFS: Most Wanted, and now I'm getting some lock ups. Is it just the game being unstable, or do I have the setting too high? Can setting details too high cause games to crash? Or is it jsut my computer?
 
Any overclocks?
Do you have the latest drivers installed for you system?

Also I see you have modded your 7800GT - did it work before you modded it?
