A burrito is not a sandwich.

That's the culinary ruling of a Worcester judge, ending, for now, a food fight between Panera Bread Co. and Qdoba Mexican Grill.

The burrito brouhaha began when Panera, one of the country's biggest bakery cafes, argued that owners of the White City Shopping Center in Shrewsbury violated a 2001 lease agreement that restricted the mall from renting to another sandwich shop.

Not so, Qdoba countered, submitting affidavits from high-profile experts in the restaurant and food industry. "I know of no chef or culinary historian who would call a burrito a sandwich," Schlesinger said in his affidavit. "Indeed, the notion would be absurd to any credible chef or culinary historian."

"A sandwich is not commonly understood to include burritos, tacos, and quesadillas, which are typically made with a single tortilla and stuffed with a choice filling of meat, rice, and beans," he wrote.

Dude, that guy is just pissed that he might have some competition and didn't think of it all when he tried to get an exclusive contract.

Uh... yeah... a burrito is not a sammich. Sammich requires bread.

Calling a burrito a sammich is like calling a pizza a sammich.

Has anyone had Panera's pizza? It's crazy expensive for what you get, I think. I haven't tried it yet because they only have it after 4:00.

The judge's ruling seems eminently sensible and fair. I'm rather surprised that he would have to rule on such a thing.

A burrito serves the same function as a sandwich, a means of creating a portable food item out of ingredients which themselves may not be individually portable.
Furthermore, there are not any "rules" as to what can be placed in a burrito or sandwich. A burrito is simply a subset of sandwich, a kind of "edible container" for food you are about to eat.
