It basically says: "since we suck at catching street racers, we're going to start pulling over cars that look modified, and ticketing them for having equipment on thier car that isn't CA smog legal"

Such a load of crap. If I get pulled over, they're not going to get the hood open without a search warrant. I have a smog legal car that I race on a legal racetrack, I don't need to be harrassed by the police.

Of course, my car doesn't really look modified, but that's not the point.

Good. Considering that many people have died already, I think that this is a great idea, and very clever.

So? They are breaking the law...they know it... they should get what's coming to them. Your car doesn't look modified... so what are you worried about?

Who's getting harassed? People are dying, but we don't want the police to do anything about it. We'd rather sit and complain that they aren't doing anything. Heaven forbid they try to solve a problem, what would we complain about then?

Welcome to the adult world. Police don't need a warrant to search a car, the car is mobile and the time to collect a warrant is excesive (unless you wanna be detained for 3 weeks while they get the warrant). All they need to search is probable cause. Probable cause would be indications that the car is modified. If your car even sounds different than a normal car that would be probable cause.

Whahaaaaa.... Oh sorry, I was whining for you.

this isn't new in SoCAL, they've been doing this for years. Almost everyone I know has been ticketed for things like having an aftermarket exhaust, car too low, etc (including myself). None of us even street race (it's not worth it). I think it's just revenue generation for the police departments and they need to justify their actions to the public by making it sound like they are saving lives by preventing street racing.

WTF is this all about? Nice, lazy cop, there. I guess it is nice to be able to catch would-be criminals without even thinking about it.

What they don't realize is that in 3 years, there will be no statistical evidence to indicate that this kind of law enforcement has any effect on either street racing incidents OR smog levels.

If you want to better enforce emissions rules, fine.

But I think if you're going to be issuing someone a citation requiring them to take their personal time and expense for a smog test, you better have to be 100% sure that they have a modification that will cause them to fail, or there should be consequences.

So you would rather they spend all their time and resources trying to catch street racers in the act? Oh yeah, that's right, cops don't do anything. They drive around and give out tickets....nothing else. I guess next time somebody is trying to kill you, you could call a plumber.

Like rahvin said... they don't need a warrant. It isn't unreasonable search at all. There is a legitimate concern, the head on approach doesn't work, so they are being creative to solve the problem. Tell you what, why don't you sit in a car for 8 hours at night, in one place, and try to catch a street racer. Then they wouldn't have to do this!

Smog sucks. Modifying your cars to be smog-illegal is an extremely lame and cheap way of making your car go faster. To hell with the people that make their cars smog-illegal. Don't do the crime if you can't do the time.

Sorry but you are out of luck. No warrant is needed to search a vehicle as long as the police officer has a reasonable suspicion that there is evidence of a crime inside. In this instance, if he had a good-faith belief that your car was illegal in some respect (because, for example, it sounded too loud), there would be nothing illegal about forcing you to allow him to look under the hood. The Supreme Court's longstanding rationale for this is that roadways and motor vehicles are a highly-regulated area and so you have a lesser expectation of privacy in your vehicle than you do in your home.

That wasnt the point of this thread. The point is that they will be pulling over cars that LOOK like they could be smog illegal. By that definition, they could pull over a car with clear brake lights because "he may have a aftermarket illegal cat. converter." Do you see the problem with this?
