Unless they filed this patent quite a while ago, or it is significantly narrower than this article makes it sound, prior art will completely invalidate this claim.

Mine actually converts any music synced to it to WMA, so it's technically not an MP3 phone (Verizon RAZR V3m). I don't think the ringtones are even MP3s.

If they actually now HAVE the patent, then it was almost certainly filed a few years ago.

I would think that something as vague and general as that would be something unable to hold a patent. Putting buttons on the front and/or side seems a pretty obvious thing and as such not something that should be protected by a patent. Ditto with sidespeakers; it is an obvious location.

Yes, you are missing the fact that they possibly applied for the patent BEFORE these phones became available.

Yes, you are missing the fact that they possibly applied for the patent BEFORE these phones became available.

I would figure though that development of MP3 phones took several years as well and company's would not be so stupid and not see if they have the patent or could at least License it.

Hehe... Apple's iPhone falls directly into this category. Can't say I care for Apple much but I'd love to see these extortionists try to collect. Apple's lawyers would roast them.

That would be my point. These guys are trying to tell me that they patented Mp3 phones before the people who actually created them? I doubt that.

They're going to charge the COMPANIES that make such phones royalty fees if this patent is legit and enforced. If you own one of these phones, you're not going to see any difference unless they win their lawsuit and the company passes on the fees to you in the way of higher contract rates.

You can bet those companies will fight tooth and nail not to pay them.
