Leyritz arrested for vehicular homicide, DUI

FORT LAUDERDALE, Fla. - Former major league baseball player Jim Leyritz was arrested Friday morning on suspicion of DUI and vehicular homicide, TV station Local10 reported on its Web site.

Leyritz was driving a Ford SUV that collided with another vehicle in downtown Fort Lauderdale, police said, Local10 reported.

The female driver of the other car was ejected and died at a local hospital, police said, Local10 reported.

Leyritz was arrested after refusing to take a Breathalyzer test, police said, the station reported. He was booked at 4:30 a.m., Local10 reported.

Leyritz played for six different baseball teams, including the New York Yankees, and retired in 2000.

OK, this guy should be procecuted to the full extend of the law but is he realy responsible for her death if she was not wearing a seat belt?

Yes. And the article does not state that she wasn't wearing a seat belt.

As a Braves fan, I wish it had happened about 12 years ago.

Based on how the laws are written at the moment, it really does not matter what the circumstances are. If someone else dies in an accident involving a drunk person, that person is prosecuted for their death.

Ex: About six years or so ago friend of the family was driving a car with a BAL of .08 (laws had just been changed to .08 a month before). There was ANOTHER driver who was driving his motorcycle drunk while also wearing sunglasses sometime around midnight with his gf on the back. He approached an intersection and made a left turn while the light changed to yellow. He did so because the car coming the other direction slowed to a stop. The motorcycle driver came around the car and plowed into him.


Oddly enough, MADD came out in support of the motorcycle driver and comdemned the murder by the first person.
