Legality of MP3's Divx and so on...

This is probably a stupid question but is it illegal to have these things? Or just illegal to distribute? How about to download? I know all I have seen is people being arrested for providing access to files not for having them.. Thanks..
 
I don't think they're illegal but if you're providing access to them in an easy-access situation (ie, a college campus) obviously that's a problem

I believe if you don't own the CD or DVD as well then it is technically illegal, but no one is going to come knocking on your door if you are not distributing thousands of mp3's and movies easily (at least not yet 🙁).

I'm not arguing, they very well may be cracking down. What was your letter about?

it said basically to stop sharing files...not downloading, but sharing....apparently they are trying to crack down on people who distribute, not download

it's not illegal to own. it's illegal to circumvent copyrighted material. if you obtained your files from a way which does not implicate fair use and crosses the border of illegal circumvention, it's illegal.

MP3s and DIVx and such arent illegal. what's illegal is sharing these files with other people.

you can have 2000 MP3s and the RIAA wont care, just as long as you own all these CDs and you're not sharing them.

that will probably change soon though
 
just because the RIAA doesnt want people sharing their mp3 collections doesnt mean its illegal. the fact of the matter is the legality of sharing your mp3's and divx files hasnt been determined yet and the laws arent very clear on this issue. it is illegal to distribute copyrighted material but it is NOT illegal to allow friends and such to borrow material that you own that is copyrighted. so you can definetely argue that because no court has outright said sharing your mp3's and divx files violates laws, and since the laws are farily ambiguous in this matter, that you can share your mp3's and divx files. of course if you have a collection of 130gigs of mp3s and are actively sharing these via your 1000mbit connection 24-7 via kazaa or whatever then your definetely at risk of the RIAA bringing a lawsuit. the RIAA knows they have a lot of money compared to the folks behind napster, kazaa, or any single person with a large collection of mp3's, and because of that they can simply litigate any one person or small company into the ground and thus get there way. the courts wont rule on this matter until somebody with enough legal power takes this matter all the way to the supreme court, because thats certainly where it would end up if somebody ever went toe-to-toe with the RIAA.

I'm curious how they got a hold of your email address? What sharing program were you using?

fair use generally means you can convert materials for your own use only. if u give or sell it to others that don't own the original material its theft.

The RIAA/MPAA don't usually send you an email, they contact your ISP who lets you know of the problem and passes on a letter.

If you don't own a copy of the works in their original form, its probably illegal to have a mp3 or divx of them. A divx video though from a dvd would always be illegal, at least technically. While it should be protected under fair use, the DMCA makes breaking their CSS protection illegal. What would happen in court, who knows?

They largely just go after the providers, but don't forget the RIAA has won the appeal for making verizon turn over the names of some downloaders. Their fate at the hands of the RIAA has yet to be seen.
 
As the laws stand now. It is illegal to download any MP3/Divx/MPEG4/WAV/WMA/AIFF/RM file that you do not legally already own a copy of.

I just avoid it altogether and rip the cds myself. That ensures its done right anyway. I hated downloading songs and having them corrupted, or not the real song i was looking for, or horrible quality.

I havent ventured into decoding my DvD collection yet but im getting there 🙂 I have over 700 legal, self-ripped MP3s.
