We'll I think my parents are finally in the brink of seperation. My dad is talking about moving to our house in florida while my mom is going to stay up here, rent an apartment and life with me (I'm 18). My mom want's half of the house in florida because it's in her name and she's been fulling paying the mortage for the past year. BTW we bought the house a year ago. Will my mom get the money only if they agree to sell the house? (which my dad will never, he'll just sit on it and live in the house) or can my mom somehow get the money. She want's it to start a new life in brazil and help with my college expenses. What options do we have?

Go talk to a lawyer. The laws for divorce ect. are different from state to state. The best way to know what your real options are is to go talk to a lawyer.

WE? Let your parents handle their own divorce and division of property. I realize that this is your mom, and you want to help her, but you need to let her be the adult and take care of herself. You need to take care of your own college expenses instead of leeching of your parents.

If the woman raised the kids and kept the house(as did my Mother) they are entitled to half. How would you like to see your Mom left out in the cold after 25 years of marriage because your Dad made all the money?

Well actually they're not married. Both my parent's names are on the mortgate or deed (dunno which but my mom owns half and my dad the other). Actually it's not a question of fairness since they both payed the same roughtly. My dad payed the downpayment of 17,000 while my mom payed the mortage for a year. So they evenly contributed to the house. I wasn't say that I wanted the money for college its just one thing that my mom said she wanted to do with the money. I know I don't want it/need it but she would pay anyways... So what does ths law say when 2 individuals own property?

If they are not legally married, then the family court law has no direct say. Common law marriage may come into play depending on how long they have been together.

Since they are both on the paperwork for the house in Fla; then one must either buy the other out or the place could be sold and the proceeds split according to some formula developed by overpaid legal leeches unless they can come to some equitable agreement on their own

Not meaning to be a grammar nazi BUT, I sure hope you scored high on the math section of the SAT's.

Community property laws vary from state to state. That's why lawyers love divorces.
