You'd be screwed either way. Whether you were provoked or not, it's assault and you were not exactly defending yourself. Situation 2 might get you some "mitigating circumstances" to lessen your sentence though.

Did you have fun at the sporting goods store?

Also depends on the DA and the Judge. I don't know too many states that tolerate vigilante justice and with good reason.

And since race was brought up, #2 can also be labeled a hate crime which isn't going to help matters.

what does rape have to do with hate? A hate crime involves an attack on a person because of racial, religious, or ethnic status or beliefs.

Because the OP brought up race. This "crime" has nothing to do with rape. It has to do with an individual pre-meditating murder. If rape is used as a reason behind it, then so can the fact that the victim is mexican (and by the OP's response, it isn't a stretch to label it a hate crime).

oh...he edited the post after I read it. noit likely it would be a hate crime anyway, unless the attacker used racial epithets or made it clear that his race was a factor

I was thinking that the attacker would be out of luck just because the judge can be sympathetic toward the rapist based on race.
