Legal question.

Lets say a guy and a girl are talking in a chat room. The guy is 28 and the girl is 16. The problem is, the girl says she is 19. They have an "internet romance". After awhile, they send pictures...some of them are a little innapropriate. Then, a little while after that, the girl tells him the truth that she is only 16. The guy quickly deletes the pictures she sent him and all others that she sends him...but they continue to talk and he says they should wait until they are 18 before they see eachother, but can still continue to talk.

The father of the girl finds out and decides to press charges of exploiting a minor, child pornography, etc.

What happens? Is there any criminal intent? Is there any credibility to the plaintiffs side?

Hehe, nah. This was a homework question for my political science class. We're allowed to work together and outside of class, but we have to have a good paper written with as much information as we can possibly come up with.

I think that as soon as the guy found out how old she was, he should have discontinued all communications with her. At that age difference, what in the world would he have in common with her anyway?? Even at 19yrs old... the thinking mind of a 28year old guy and a 19year old girl are vastly different.

As far as her only being 16yrs old... In this day and time... that is a lifelong stigma that is not worth carrying. And as they say... the grand jury can indict a ham sandwich.

He needs to disconnect and find someone who is of legal age.

I would think he's OK. Seems to me when I watch those Perverted Justice - type shows that the perv has always been informed by the girl in their internet chat discussions that she is underage. They always present the perv with copies of their discussion proving that he knew. I suppose they do this because "intent" must be proven.

That's not the case here.

Also, need to check state laws. Seems to me that I've read that 16 yrs is old enough in many states. It came up often in the recent Foley scandel.

You should hopefully be more mature at 28 that you don't need to hit on 19 year old egirls, and you definetly don't need to be talking to 16 year olds.

Considering they exchanged photos, he should have cut off all contact with the girl. If he had copies of their conversations, where she stated she was 19 it would be a very good thing for him legally.
 
This is a useless question without knowing what state the parties are in and/or the wording of the laws the guy is going to be prosecuted under.

(BTW, in criminal law, there are no plaintiffs. Generally speaking, there is the prosecution, the defense and either the complainant or the victim.)
