Legal Question regaring use of Windows backgrounds

I want to use one of the background images that comes with Windows as the background of a webpage I want to make. Is that legal? Do I need to put any type of copywright disclaimer or something?

You would need to get the permission of the person who holds the copyright to the image.

Yeah I think it's kind of cheesy, but several people used the textures that I created w/o my permission and I really don't care.

They are lucky. You could have them take it down if you wanted to.
