Legal question regarding property lines and trees

In my backyard there are two trees growing (10-15 feet tall each) that have a lot of branches at low levels that I would like to prune. Now I am not sure on the exact property lines but the trees appear to be directly on them if not slightly on my neighbors property. Will I run into problems if I prune the lower branches that pass through the fence onto my property (chain link fence dividing the yards)?

no...if they are on your side of the line, you can prune them.

well, that is allowed where I live...YMMV

In my township, it is perfectly legal to do what you say. In fact, I had to put up a fence and to do so required pruning a set of trees that were on my neighbors property. I ended up getting him to do all the work.

Yes you can do it (here at least) but if you damage/kill the tree, you are liable.

Yet Another Jumpem Hates the Suburbs Post. Hey, imagine this - different people have different priorities.

I'm used to it. I drive 30k miles annually, mostly just going to work.

Roughly $9.34 a day going to work with current gas prices.

Some people are willing to live closer to their neighbors so they can live closer to work. :Q Now STFU and stop posting this crap in every thread that indicates that someone lives on a smaller lot than you.

To the OP - I've been told (by a tree service) that I can prune my neighbor's branches that hang onto my property and vice versa. Of course I don't live where you live. Best to be a good neighbor and get permission first anyway.

No I have not as we do not get along. They accused me of something I did not do, I snapped on them (well one of them) and now we don't talk. We do the occasional neighborly wave, but that is all.

Can he have sex with it while wearing a Richard Nixon mask while a 6 year old girl watches?

The OP did not mention, but what if the fence line is 300 feet away? Is that still "on top of your neighbors"?

In MOST places, it's completely legal to trim any branches that overhang your fence/property line, and that also gives you the right to pick any fruit that overhangs the line. I harvest quite a few of my neighbor's peaches every year...I'm just careful NOT to actually reach onto their side of the fence in the process. By the same token, they trim the branches on my crape myrtle that over hang the fence line. As long as they prune them properly, I don't care.

You should call your town to find out. Most places you will be fine, but better to be safe.

You usually have 3 miles up from the property line. If a tree comes across it you can remove it. If it will kill the tree however; it's best to negotiate this. The owner will have to have it removed either way, but if you just go and kill the fucker he can have a right to sue. Mature trees are EXTREMELY expensive so you don't want to go there. If an arborist kills the tree they usually have insurance for such things.
