Legal question, f'ed up situation

So my GF works at a local drug store. The girls bathroom in the basement caught on fire. Its the place where everyone smokes.

It started about a half hour after she was down there, and other people were down there before and after her. She said she was absolutely 1000000% positive that she put hers out before she dropped it in the trash, same with the person that was with her.

So after it caught on fire, everyone got called into the office. The manager claimed that her and the other girl were the last ones down there. This is where it gets good.

The manager claimed he had an audio tape of the two of them talking, proving they were down there. He said to her "Dont make me explain to you how this works, if you have something to tell me, tell me now. "He basically scared the sh*t out of her and coerced her into signing a document saying that she and the other girl down there had a stoge a half hour before.

The next day she finds out the tape doesnt even exist. He lied to her to get her to sign that document. Nothing will probably happen to her, even if she doesnt get fired, she's going to quit, regardless that it wasnt even her fault.

Can she sue or nail that shady bastard to the cross? That has got to be against some law.

I wouldn't think so simply because he isn't using it against her, i.e. the signed statement is being used. Otherwise, it would be a coersion. But if he coerced her and then did nothing with the results, who cares. Let the guy deal with her burnt out bathroom. He obviously deserves it.

She will have a much better chance to successfully sue if she gets fired instead of quits. In fact quitting might be a mistake all around, it would look bad if they turned around and did sue her.

did she hear the tape? wouldn't it be illegal to make a tape of a bathroom? that seems weird

Well if she signed she must have been down there right? I mean if somebody said "I have a tape of you down there to prove it" how can the scare you into signing a document unless you know they MIGHT have a tape, and they could only have a tape if you were indeed down there?

coersion like that is not illegal. Cops do it all the time to get people to admit to stuff.

Well, to sue and successfully collect, your GF would have to establish damages... situation sound a bit odd all 'round.

BTW, when I used to smoke, and even now if I'm using matches for purposes other than smoking, the only way I'd be "1000000% positive" that my burning object did not cause a fire would be to either a) throw it into the toilet and flush or b) run water over it before throwing into trash. If the method to put out smoldering object was just to grind on floor etc., then I do recommend the application of water instead.

was exactly what was done. Both of them.


The guy showed her some sort of contraption that he claimed was a recording device, and told her to fess up. She didnt hear the tape, because she was scared. She didnt want to be accused of something she didnt do. The guy convinced her that nothing would happen and all she had to do was sign the document saying she was simply down there and had a stoge.

She doesnt want to sue, but I dont want anyone taking advantage of her.

He bluffed her to get her to sign. Taping in a bathroom is probably illegal, but lying about it (and not taping) probably isn't.

Let's say it's illegal. What would that mean? Her signed statement gets thrown away? I don't see what the point of the statement is anyway.

If she's going to quit, she should quit and let it go. She will waste a lot of time and energy for nothing. Sometimes people feel that walking away means the other guy won, but I don't see it that way. She's cutting her losses, which for her is probably the right thing to do.
