Legal question about a job...

I'd much rather be case 2. The key isn't the total amount you make in a certain time frame, the key is how miserable you must be when working 10 hours a day at a measly $7 an hour.
 
My wife worked in a fast food place before we got married... much the same situation. The boss would write out paychecks for the employess, but would require them to cash the check out of the register. He is now doing time for federal tax evasion.
 
Now is this totally illegal?? Or is it my choice if I want to not pay taxes and loose the potential social security as well as help from the gov't if I were in need of it?

Since you're happy with the job, am happy for you.

Talk to you co-workers that have been there for a while and see what they get.

If you talk to them first about 1099 then they might give one to you next year or probably forget.
 
I've done this, but only for short period side-jobs. (ie: 1-3 days) Anything that made a signifigant amount of money I got W2s from.

There are plenty of dumber people, he's simply ignorant of the law.

I personally wouldn't do what you are doing. If he reports your wages you owe SS and taxes that aren't being taken out and if you don't make quarteraly payments on those you will be charged penalties and interest. If he doesn't report your wages he's not going to be in business very long as he will be spending time in federal prison in a matter of time.

You also have other major risks; no benefits and you aren't protected by unemployment insurance, workmans comp or any form other worker safety type state mandated benefits, and if SS does happen to still exist when you retire you aren't accumulating the years you will need to draw reasonable benefits.

Independent contracting is only reasonable if you are a white collar worker or you are truely independent (ie not working on their premisises), and working under the table is fvcking stupid.

I will guess you're at least 16, and yet SOMEHOW have managed to get this far in life without understanding the fact that taxes are mandatory. That you even thought for a flicker of a second that taxes were optional is just, to me, totally incomprehensible.

Who in all hell is going to pay for roads, military, emergency services, etc. if taxes were optional? I can see the validity of your question vs. social security, and for that I meant no offense, because that's a good question (can I skip SS and then not receive benefits, which I can't unfortunately), but in terms of "not paying taxes and not getting help from the gov't" really that's just insane.

If you're looking at this from the angle of just getting cash and then paying it yourself as a contractor, hopefully some others have answered that question to your satisfaction now.

well i guess that im getting on the payroll now. so that means papers and im lagit.. i guess i wasnt working enough for them to think that i would want to be on it, or something... but its taken care of now.

and i guess mainly i was unsure where the line was drawn with the taxes thing.. because i mean lets say some old lady pays me $ to mow the lawn for her on one occasion. Do i have to pay taxes on that? what about if i do it often? where is the line drawn? i know the basics about taxes, and i figured that something was wrong with what I was diong, but i just didnt know all the technicalaties.
 
if it's under the table you should be getting paid in cash

checks can be tracked and such, the IRS is gonna own someone if they find out

No matter the situation you are required to pay taxes on it. Now the question you are asking is how much can you earn with plausible deniability such that the IRS can't prove you made that money. That's pretty subjective, but as someone said, income without a paper trail, that is done all in cash, is very difficult for the IRS to prove a transaction actually occured. But according to strict interpretation of the law you should claim that $10 the lady paid you to mow the lawn in your AGI and pay taxes on it.

Yup you rob a bank you better pay taxes on it. (that's how they finnaly got capone, not murdering, drugs and other stuff he did but not paying taxes on that stuff) Tax evasion is serious biz and criminal. You're actually waaay better off telling IRS "hey I made XYZ exactly but don't have a single dime to pay you" than evasion of any type.

it's not illegal if they do 1099 on you and you file it.

which kinda sucks as you get hit at the end of the year with a big chunk of tax. (seems like a lot because it wasn't withheld in the first place)

it's not illegal if they do 1099 on you and you file it.

1) You can put aside the funds to pay the tax of the 1099.

2) You can list expenses related to the 1099 type income and therefore reduce/elimate the tax burden. See some of the comments that were in this years tx thread on what/how to do this for next year.

 
Yes, it is illegal. Why do you think they call it "under the table"? If you want to opt out of government services (which isn't a choice btw), then you'd better give back that public education, get off those public roads, turn off your water and electricity, and go to a part of the U.S. with no military or police protection.

Pay your taxes or you will be screwed.

okay.. lol.. i get the feeling that ppl are not looking at the other posts in this thread.. a common thing to do i guess though.

But i got that tax evasion is illegal!! RossMAN's links rocked my socks off.

and thanks Zebo.. I wished I had a degree in Chemestry. I love that stuff. But im doing a bach in pc networking & admin😀
