I had my car broken into a while ago. And some things were stolen. I didn't feel like going through the insurance trouble since it was all small stuff and I didn't report it to the police since one of the items stolen was a "home video" of me and my girlfriend at the time. We were both underage in the tape but I just held onto it for keepsake. It looks like I have found out who has possession of the tape and they are threatening to put it on the internet. What legal actions can I take or what can I do to protect myself. I want to nail the guy who stole my stuff but I don't know how to go about it since I can't really prove he broke into my car and so forth. I was also wondering what kind of legal action I could get in myself. Any help would be greatly appreciated..

That's an understatement. I don't care about it that it's got me in it, I'm just trying to save face for her. This is really important. Anyone with any law/legal backround have any input?
 
This is interesting to say the least.

My best guess is that you should inform this person that the individuals on that tape were both underage at the time it was made. He would then be knowingly in possession of child pornography with the intent of distributing it. That's easily worth an extended stay in a pound-me-in-the-ass hotel.
When/if you ever get that tape back, I would advise destroying it immediately.

edit: I'm no lawyer though. You want legal advice, you should try calling one.
 
Unless you want to call the cops (and they likely wouldn't do a darn thing, considering the break-in was so long ago) you're SOL. Too bad for you. Next time don't have underage sex on video.

Not much you can do legally. I don't suppose you have enough clout or know the right kind of people to be able to help you work him over physically for this, do ya? (you know, knee caps, dental work, the whole bit) Anyway, what's he trying to extort from you? If it's money, you might as well give him access to your bank account, because you'll never stop paying a guy like that.

You're as metaphorically fvcked now as your girlfriend was physically in the video, no matter how this goes.

Aside from physically getting the tape back (he's already got electronic copies, though...) the above is your only recourse.

Obviously, your parents don't know about this...but it might be in your best interest to consult a lawyer.

Here's the rub:

If this guy puts the video out on the net, he's legally guilty of possession/distribution of child porn.

HOWEVER:

You are legally guilty of Statutory Rape. Not a good thing.

Threaten him and hope his stupidity wins out.

I don't see a problem here. You know who is blackmailing you? Either you kick his ass - seriously hurt him, or he gives you the tape back. You can't be a pussy here. This is FAR too serious. Get some help if you need it.
