.Legal for company to not pay you 1.5 time over 40 hours?

I am on an hourly wage here, and never signed anything saying that I should get half time for time over 40 hours.Is that legal?

Thats why I never work over 40 hours a week here, even if they need me. As soon as my 40 hours are up, I immediatly drop everything and go home.

EDIT:I mean that pay me "half" of what I normally get every hour after 40, so if I normally make $1.00 an hour, they would pay me .50 an hour.
 
Let me understand this. They pay you 50% of your wage when you go over 40? That's not legal.
 
no that is not legal. but if you are salaried, but seems you aren't from your original post, then they don't even have to pay you for over 40 hours. but then again, you don't have to work over 40 hours either.
 
I believe he means that currently if over 40 hours they just pay you the normal wage, and he's wondering if it's legal for them to not pay 50% above the normal wage, or, as he mentioned it "1.5 time."

I don't know the answer, I just decided I'd articulate!

What is your job title and pay rate?

Under Bushs new Overtime rules they migth be able to, but it does not sound like it from what little you have said.

Its not that complicated bro. Lets say I get payed $1.00 an hour. On a 40 hour pay check I would get $40.00, on a 39 hour pay check $39.00, on a 41 hour paycheck $40.50, on a 42 hour paycheck $41.00... get my drift?

 
Forgive us, but your post really makes no sense. Are you saying that if you make $10/hr., beginning on hour #41 you receive $5/hr? If that's what you mean... then you're insane for truly wondering if it's legal. You're supposed to make $15/hr, not $5.

then that is not legal....but some places do it the following way....

if you work 42 hours, , it's 42 * rate = pay.....

then, in a seperate section, they take those two hours of hour time and do : pay/2 *2 = overtime pay.

overtime pay +pay = check, but i guess your place does not do it that way.
 
I don't see how that could possibly be legal, even with some of the crap that the current administration is trying to pull. Under the old system, that would be illegal. Is your salary at least double the minimum wage? If not, then they'd be breaking more than one labor law.

First of all, I am still a college student so I usually work part time here. Whenever I can, I try to pick up hours over the weekend, so sometimes I do get 40 hours. There have been times when they needed me over the weekend when I was not in school over the summer, and I said no because I reached my 40 hours and did not want to get payed crap.

However, the only reason I stay here is because the job is *so* easy, and it is really relaxed around here. I pretty much come in and leave when I want, so I can adjust my hours around school. I dont have to wear a uniform either, I jsut come in with whatever I wear to school (usually a t-shirt with blue jeans). It kind of reminds me of George Castanzas last job on Seinfeld, when he was working for Kruger.
 
That doesnt make sense at all..

To be sure, are they perhaps paying (assuming you work, 45 hours) 45 hours at your rate, and then 5 hours at half the rate? It's convoluted, but a few companies around here that use Ceridian have that break down...

Just curious, but it does sound like you might be getting the shaft...

Edit: in case you were confused as to why I asked if you made more than twice the minimum wage: if you get paid half your normal hourly wage for the hours over 40, then you might be making less than minimum wage for those hours, which is illegal.
