Yes, I know, go to a lawyer. That is going to happen however, I am trying to find out some general info first.
This is not for me. My mother in law's(MIL) father has been in an assisted living facility. My mother-in-law's brother has power of attorney and as such the only one with access to financial accounts.
Last week, my MIL's father got admitted to the hospital and then to a full nursing home. The problem is that my MIL's brother refused to come up and sign any of the hospital papers. He also refused to sign any of the paperwork for admitting him into a nursing home. My MIL had two choices. Either take her father home where she has no means to care for her father or sign the paperwork(not sure if there is anything legally binding because she has no court ordered authority for her father's care).
My MIL is now worried about being on the hook financially when her brother has power of attorney and all the bank accounts. What recourse does my MIL have in regards to her brother. She just wants him to perform his required duties as power of attorney. Can she have him stripped of power of attorney for failure to perform his duty? She doesn't want that responsibility because she was power of attorney for their mother and dealt with all the stuff until she died. They had both agreed that he would take care of their father when the time came.
