leaving cars at the bar

this is something i always found confusing.

let's say you go to the bar, get drunk, walk home. (no designated driver, i guess.) do you leave your car at the bar and get it the next day? wont bar have you towed or something?

I'd be willing to bet that bars would rather allow people to leave their cars overnight than to be held responsible for someone getting a DUI and blaming it on the bar.

I've left my car and other people have as well. I always check when I park in the parking lot if they have towing signs. Most that I've been to don't.

If you left it there for days, then I can see it getting towed. But I don't know an bars that tow it just for a night.

I've not seen/heard of that, but I do know people that have been arrested for public intoxication on their way (walking) between a bar and home.

If I'm ever worried about driving home I ask to speak with the manager and ask if I can leave my car and come get it first thing in the morning. They have always been very willing to help me out so far.

I've heard of this as well. It probably wouldn't hold up in court, but if the cop decides to be a dick he could charge you.

There are even cases of people getting a DUI when they were not even driving their car. A person can receive a DUI if they are standing outside next to their car with the keys in their pocket. The officer can say that he or she had the intent to drive, and book them with a DUI.

He wasn't walking, he was walking his bicycle. Though in my jurisdiction, we actually have a BUI statute and don't throw it under the DUI statute.

there is a difference between walking home, ie the opposite direction of the bars and the probable parking spot for your car, and standing next to it with keys in hand or pocket.

My sister pulled out in front of a cop one time and he tried to charge her with intent to damage a police vehicle (whatever that BS is). The judge said, and I quote, "No bent metal, no accident. Case dismissed." He then proceeded to scold the officer for his actions.

This would be my response to this "intent to drive" garbage. Until I put the vehicle in gear I have not shown any "intent" on moving the vehicle.

It's the law for bars to have as much parking space as the building can fit people, and it's for this exact purpose, cars can be left overnight. People do it all the time here.

Now the issue is in bigger higher crime cities there's probably a high vandal/theft rate in bar parking lots.

50% of the time, you are going to have to walk past your car when you leave the bar.


Note that I said you *could* get a DUI for walking home, it's not a 100% sure thing. Just like you could drive home drunk without getting a DUI.

I don't know a single bar that would tow a car left overnight. If they did they would see some shitty business. It's in their best interest to do what they can to accommodate their customers... especially when it doesn't really cost them anything.

I've not heard that extreme of a case but being in your vehicle with the keys in the ignition can be bad. I've heard of it and know someone personally who had that happen (sleeping in his car). So if you're sleeping in your car drunk, at the absolute least do not have your keys in the ignition. Even then I'm not sure it'd be safe if the cop is an asshole.
