Leaning Athlon 64 retail heatsink retention clip lever

I just installed an athlon 64 3200+ venice (retail) onto an MSI platinum 939 board last night. The processor is the retail version that comes with the heatsink/fan. Is it normal for the heatsink retention clip lever to lean about 30 degrees after it is locked down? Everything seems pretty tight. I just wonder if I bent it out of shape or something. Does anyone remember if there's looks the same?

This is probably something I don't need to worry about, but they don't call me Captain Stress for nothing! Thanks.
 
I am having trouble figuring out what's going on in that photo, but there is a flatter surface on one side of that plastic clip.

The flat surface of the clip should be the part facing downwards, & on mine anyway, it looks about level, maybe slightly tilted up actually, when on.
However, your HSF is slightly different than my stock one.
Take the picture from the side view & i might be able to see what's going on.
